Adopt a Resolution accepting all off-site public improvements; accepting the Maintenance Bond; and releasing the Improvement Securities for Conditional Use Permit (“CUP”) No. 00-10, developed by B.P. West Coast Products/ARCO (“Developer”), located at Lone Tree Way and Empire Avenue.
On June 5, 2001, by Resolution No. 01-40, Planning Commission approved CUP No. 00-10, with conditions.
This project was approved for a gas station, convenience store and car wash located at the southwest corner of Lone Tree Way and Empire Avenue. All improvements required by the Conditions of Approval for this project, such as sidewalk, landscaping, paving and utility connections, have been constructed and inspected for conformance with the approved improvement plans. As a part of the project, the Developer has contributed their fair share to the cost of Lone Tree Way widening, constructed by the City Capital Improvement Project and subsequently completed the parkway sidewalk and landscaping.
As a part of the project, the Developer has installed the following public improvement quantities: 9,575 Square Feet (“SF”) of parkway landscaping and 1,900 SF of concrete walk. With the improvements now installed to the satisfaction of the City, it is the appropriate time to accept the improvements and begin the warranty period.
Most of the improvements associated with this project are privately owned and maintained; therefore, upon acceptance the City will incur only minimal annual costs associated with necessary maintenance of the public paving and concrete. Routine roadway maintenance will be funded by the General Fund and Measure “C” transportation sales tax, with sewer and water maintenance funded through their respective enterprise funds. Landscaping and Lighting Assessment District (“LLD”) No. 02-8, has been formed for this project and will be responsible for the landscape maintenance should the property owner not maintain the improvements to City standards.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING ALL OFF-SITE PUBLIC IMPROVEMENTS; ACCEPTING THE MAINTENANCE BOND; AND RELEASING THE IMPROVEMENT SECURITIES FOR CONDITIONAL USE PERMIT NO. 00-10, DEVELOPED BY B.P. WEST COAST PRODUCTS/ARCO, LOCATED AT LONE TREE WAY AND EMPIRE AVENUE.
WHEREAS, on June 5, 2001, by Resolution No. 01-40, Planning Commission approved Conditional Use Permit No. 00-10, with conditions; and
WHEREAS, the required improvements have been completed and constructed in substantial conformance with the approved improvement plans.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood with respect to Conditional Use Permit No. 00-10, developed by B.P. West Coast Products/ARCO that:
1. All off-site public improvements are hereby accepted for maintenance.
2. The Maintenance Bond is hereby accepted.
3. The Improvement Securities will be released within sixty (60) days of the passage of this Resolution.
4. The City Clerk is hereby directed to file this Resolution with the Recorder of Contra Costa County.
