RECOMMENDATION
Adopt a Resolution accepting Randy Way sewer line improvements.

PREVIOUS ACTION
On June 6, 2006, by Resolution No. 06-27, Planning Commission approved Tentative Subdivision Map (“TSM”) No. 8311, with conditions.

On May 9, 2006, City Council directed the City Engineer to proceed with Assessment District financing for funding the construction of sewer utilities to service the Randy Way neighborhood.

On February 27, 2007, by Resolution Nos. 2007-34, 2007-35 and 2007-36, City Council initiated the Randy Way Sewer Line Assessment District and set the public hearing for April 24, 2007.

On April 24, 2007, by Resolution No. 2007-90, City Council approved the Final Engineer’s Report, Levy of Assessments and Ordered Improvements in Randy Way Sewer Line Assessment District.

BACKGROUND
Residents in the Randy Way neighborhood were dealing with septic systems in need of repair/upgrade and/or their desire to expand their residence over their current septic system capacity. Throughout the last year and a half, the residents met with City staff regarding their interest in sewer utility main line construction to serve their neighborhood. Since these utilities are not master planned and would serve only their neighborhood, the residents were informed that the associated construction would be their financial obligation. Through the public hearing and balloting process, an Assessment District was formed and bonds sold for the financing of sewer line construction.

With financing in place, Pulte Homes, the developer of the adjacent parcel, constructed and managed the sewer line project per their Conditions of Approval for TSM No. 8311. Construction of the sewer line and associated improvements is now complete and has been inspected for conformance with the approved improvement plans. Improvement quantities installed include: 2,915 Lineal Feet (“LF”) of 8” sewer main, 14 sewer manholes, 34 laterals and cleanouts to service each residential parcel, repaving and slurry sealing of the entire neighborhood.

The necessary right-of-way offers of dedication and easements required for maintenance of the public improvements have previously been offered to and accepted by the City. With the sewer main now installed to service the parcels, it is the appropriate time to accept the improvements.



FISCAL IMPACT
Upon acceptance of improvements the City will incur annual costs associated with necessary maintenance of sewer utilities to be funded through the sewer enterprise funds.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING RANDY WAY SEWER LINE IMPROVEMENTS.

WHEREAS, on June 6, 2006, by Resolution No. 06-27, Planning Commission approved Tentative Subdivision Map No. 8311, with conditions; and

WHEREAS on May 9, 2006, City Council directed the City Engineer to proceed with Assessment District financing for funding the construction of sewer utilities to service the Randy Way neighborhood; and

WHEREAS on February 27, 2007, by Resolution Nos. 2007-34, 2007-35 and 2007-36, City Council initiated the Randy Way Sewer Line Assessment District and set the public hearing for April 24, 2007; and

WHEREAS on April 24, 2007, by Resolution No. 2007-90, City Council approved the Final Engineer’s Report, Levy of Assessments and Ordered Improvements in Randy Way Sewer Line Assessment District; and

WHEREAS, the required public improvements have been completed and constructed in substantial conformance with the approved improvement plans.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood with respect to Randy Way sewer line improvements, constructed by Pulte Homes that:

1. All public improvements are hereby accepted.
2. The City Clerk is hereby directed to file this Resolution with the Recorder of Contra Costa County.
