Adopt a Resolution accepting all off-site public improvements; accepting the Maintenance Bond; and releasing the Improvement Securities for Design Review No. 04-04, developed by JFM Development, LLC (“Developer”), located at 550 Harvest Park Drive.
On July 20, 2004, by Resolution No. 04-45, Planning Commission approved Design Review No. 04-04, with conditions.
This project, located at 550 Harvest Park Drive in the Harvest Park Industrial Complex, was approved for a 15,332 square foot light industrial building. All improvements required by the Conditions of Approval for this project, such as curb, gutter, sidewalk, paving and utility connections, have been constructed and inspected for conformance with the approved improvement plans.
As a part of the project the Developer has installed the following improvement quantities: 160 Lineal Feet (“LF”) of 18” and 24” storm drain lines including manholes, 1,194 Square Feet (“SF”) of concrete walk, 532 SF of asphalt pavement and relocation of utility vaults.
With the improvements now installed to the satisfaction of the City, it is the appropriate time to accept the improvements and begin the warranty period.
Most of the improvements associated with this project are privately owned and maintained; therefore, upon acceptance the City will incur only minimal annual costs associated with necessary maintenance of the public paving and concrete. Routine roadway maintenance will be funded by the General Fund and Measure “C” transportation sales tax, with sewer and water maintenance funded through their respective enterprise funds.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING ALL OFF-SITE PUBLIC IMPROVEMENTS; ACCEPTING THE MAINTENANCE BOND; AND RELEASING THE IMPROVEMENT SECURITIES FOR DESIGN REVIEW NO. 04-04, DEVELOPED BY JFM DEVELOPMENT, LLC, LOCATED AT 550 HARVEST PARK DRIVE.
WHEREAS, on July 20, 2004, by Resolution No. 04-45, Planning Commission approved Design Review No. 04-04, with conditions; and
WHEREAS, the required improvements have been completed and constructed in substantial conformance with the approved improvement plans.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood with respect to Design Review No. 04-04, developed by JFM Development, LLC that:
1. All off-site public improvements are hereby accepted for maintenance.
2. The Maintenance Bond is hereby accepted.
3. The Improvement Securities will be released within sixty (60) days of the passage of this Resolution.
4. The City Clerk is hereby directed to file this Resolution with the Recorder of Contra Costa County.
