Subject/Title: Adopt a Resolution accepting all off-site public improvements for maintenance and releasing the Improvement Securities for Design Review No. 04-02, developed by Brockman Engineering, located in the Sunset Industrial Complex.

Adopt a Resolution accepting all off-site public improvements for maintenance and releasing the Improvement Securities for Design Review No. 04-02, developed by Brockman Engineering (“Developer”), located in the Sunset Industrial Complex.
On August 20, 2004, by Resolution No. 04-27, Planning Commission approved Design Review No. 04-02, with conditions.
This project, located at the northwest corner of Sunset Road and Elkins Way in the Sunset Industrial Complex, was approved for the development of three industrial buildings totaling 24,000 square feet. All improvements required by the Conditions of Approval for this project, such as curb, gutter, sidewalk, paving and utility connections, have been constructed and inspected for conformance with the approved improvement plans.
As a part of the project the Developer has installed the following improvement quantities: 1,622 Lineal Feet (“LF”) of various diameter storm drain lines, 700 LF of 6” sewer line, 1,305 LF of waterline, 54,935 Square Feet (“SF”) of paving, 1,500 SF of curb and gutter and 2,592 SF of sidewalk.
With the improvements now installed to the satisfaction of the City, it is the appropriate time to accept the public improvements and begin the warranty period.
Most of the improvements associated with this project are privately owned and maintained; therefore, upon acceptance the City will incur only minimal annual costs associated with necessary maintenance of the public paving and concrete. Routine roadway maintenance will be funded by the General Fund and Measure “C” transportation sales tax, with sewer and water maintenance funded through their respective enterprise funds. Landscaping and Lighting Assessment District (“LLD”) No. 02-12, has been formed for this subdivision and will be responsible for the street lighting and landscaping maintenance in public areas.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING ALL OFF-SITE PUBLIC IMPROVEMENTS FOR MAINTENANCE AND RELEASING THE IMPROVEMENT SECURITIES FOR DESIGN REVIEW NO. 04-02, DEVELOPED BY BROCKMAN ENGINEERING, LOCATED IN THE SUNSET INDUSTRIAL COMPLEX.
WHEREAS, on August 20, 2004, by Resolution No. 04-27, Planning Commission approved Design Review No. 04-02, with conditions; and
WHEREAS, the required improvements have been completed and constructed in substantial conformance with the approved improvement plans.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood with respect to Design Review No. 04-02, developed by Brockman Engineering that:
1. All off-site public improvements are hereby accepted for maintenance.
2. The Maintenance Bond to guarantee against defects in material and workmanship for a period of twelve months is hereby accepted
3. The Improvement Securities will be released within sixty (60) days of the passage of this Resolution.
4. The City Clerk is hereby directed to file this Resolution with the Recorder of Contra Costa County.
