RECOMMENDATION
Adopt a Resolution accepting public improvements for maintenance excluding King Park; accepting the Subdivision Maintenance Bond; and releasing the Subdivision Improvement Securities for Subdivision No. 8529, Crossroads II, located north of Sand Creek Road and west of Minnesota Avenue, developed by Ponderosa Homes (“Developer”).

PREVIOUS ACTION
On September 18, 2001, by Resolution No. 01-67, Planning Commission approved Tentative Subdivision Map No. 8529, with conditions.

On December 17, 2002 and October 21, 2003, Planning Commission amended Resolution No. 01-67, and approved one year time extensions for the Tentative Subdivision Map.

On April 27, 2004, by an Informational Report, City Council was notified of the City Manager’s approval of Final Subdivision Map No. 8529 and associated Subdivision Improvement Agreement.

On May 23, 2006, by Resolution No. 2006-123, City Council approved an interim maintenance Agreement with Ponderosa Homes for King Park.

BACKGROUND
This subdivision, located north of Sand Creek Road and west of Minnesota Avenue, has been developed by Ponderosa Homes (“Developer”) and contains 56 single-family residential lots. All civil public improvements required by the project’s Conditions of Approval have been constructed and inspected for conformance with the approved improvement plans including sewer, water and storm drain lines, sidewalk, paving, streetlights and fiber optic conduit. As a part of this project, the Developer has completed north side Sand Creek Road widening and west side Minnesota Avenue widening along the project frontage. In addition, the four acre “King Park” has been constructed, which includes the first dog park in the City of Brentwood. At this time, the developer is currently working with the Parks and Recreation Department on park punchlist items. Upon punchlist completion, acceptance of the park improvements will be brought before Council.

As required by the Conditions of Approval and shown on the improvement plans, the Developer has installed the following improvement quantities: 3,011 Lineal Feet (“LF”) of 8” sewer lines, 3,105 LF of 8” waterlines, 330 LF of 12” waterlines, 2,874 LF of various diameter storm drains, 5,916 LF of 5’ wide sidewalk, 3,332 LF of pavement, 6,563 LF of curb and gutter, 19 streetlights, 3,344 LF of fiber optic conduit and 53,143 Square Feet of parkway landscaping and irrigation.

The easements and right-of-way necessary for public parcels, roadways and utilities were previously offered for dedication and accepted by the City with the Final Map. The improvements are now installed to support the new lots; therefore, it is the appropriate time to accept the improvements, excluding King Park. The Developer has provided Maintenance Bonds to cover the twelve-month warranty period for all improvements.

FISCAL IMPACT
Upon acceptance of improvements the City will incur annual costs associated with necessary maintenance of streets, landscaping and utilities. Routine roadway maintenance will be funded by the General Fund and Measure “C” transportation sales tax, with sewer and water maintenance funded through their respective enterprise funds. Landscaping and Lighting Assessment District (“LLD”) No. 99-3, has been formed for this subdivision and will be responsible for the street lighting and parkway landscaping maintenance.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING PUBLIC IMPROVEMENTS FOR MAINTENANCE, EXCLUDING KING PARK; ACCEPTING THE SUBDIVISION MAINTENANCE BOND; AND RELEASING THE SUBDIVISION IMPROVEMENT SECURITIES FOR SUBDIVISION NO. 8529, CROSSROADS II, LOCATED NORTH OF SAND CREEK ROAD AND WEST OF MINNESOTA AVENUE, DEVELOPED BY PONDEROSA HOMES.


WHEREAS, on September 18, 2001, by Resolution No. 01-67, Planning Commission approved Tentative Subdivision Map No. 8529, with conditions; and

WHEREAS, on December 17, 2002 and October 21, 2003, Planning Commission amended Resolution No. 01-67, and approved one year time extensions for the Tentative Subdivision Map; and

WHEREAS, on April 27, 2004, by an Informational Report, City Council was notified of the City Manager’s approval of Final Subdivision Map No. 8529 and associated Subdivision Improvement Agreement; and

WHEREAS, on May 23, 2006, by Resolution No. 2006-123, City Council approved an interim maintenanceInterim Park Maintenance Agreement withbetween with Ponderosa Homes for King Park; and the City of Brentwood for King Park (“Maintenance Agreement”); and

WHEREAS, the required public improvements, excluding King Park, have been completed and constructed in substantial conformance with the approved improvement plans.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood with respect to Subdivision No. 8529, Crossroads II, developed by Ponderosa Homes that:

1. Public improvements for maintenance, excluding King Park, are hereby accepted.
2. The Maintenance Bond to guarantee against defects in material and workmanship for a period of twelve months is hereby accepted.
3. The Subdivision Performance and Payment Bonds will be released within sixty (60) days of the passage of this Resolution.
4. The City Clerk is hereby directed to file this Resolution with the Recorder of Contra Costa County.
5. This Resolution does not include the acceptance of the King Park improvements and, therefore, does not terminate the Maintenance Agreement.
