RECOMMENDATION
Adopt a Resolution approving and authorizing the City Manager or designee to execute Amendment No. One to Amend the Agreement for Professional Services with Bellecci & Associates for the John Muir Parkway Extension – Phase I, CIP Project No. 336-31640, in the amount of $36,394, plus a 10% contingency of $3,639.40, for a total increased amount of $40,033.40.

PREVIOUS ACTION
On June 13, 2006, by Resolution No. 2006-130, City Council approved and authorized the City Manager to execute an Agreement for Professional Services with Bellecci & Associates to provide design and construction support for the John Muir Parkway Extension – Phase I, CIP Project No. 336-31640, in the amount of $149,450, plus a 10% contingency, for a total amount of $164,395.

On June 12, 2007, by Resolution No. 2007-126, City Council adopted the City’s 2007/08 – 2011/12 Capital Improvement Program (“CIP”) Budget, which included the John Muir Parkway Extension – Phase I, CIP Project No. 336-31640.

BACKGROUND
The John Muir Parkway extension project (“Project”) will consist of constructing 2,000 feet of road from Ventura Drive to the Foothill Drive extension to provide north/south traffic circulation and access to surrounding properties. This roadway is necessary to replace the existing Concord Avenue due to the construction of Segment 3 of the State Route 4 Bypass that is currently under construction. The City will proceed with the design and construction of the interim roadway consisting of two 14-foot lanes from Ventura Drive to Foothill Drive. The future development will be responsible for the widening of John Muir Parkway to its ultimate configuration.

The City’s portion of John Muir Parkway will include Phase I improvements as follows: one travel lane in each direction, median curb, and street lighting. Future development will complete the remaining roadway widening improvements.

Bellecci & Associates (“Consultant”) was chosen for this work due to the Consultant’s experience designing other segments of John Muir Parkway, and the preliminary design work already completed for this segment. The Consultant’s proposal under the original Agreement included the roadway design and geometrics, hydrology and storm drainage reports, final right-of-way documents, cost estimate, environmental permitting, technical assistance, and contract specifications. Further, the original Agreement included construction-related items such as field staking, construction support, and record drawings.

Since the execution of the original Agreement on June 13, 2006, additional tasks have been identified and need to be added to the original scope of work for this Project:

• In an attempt to minimize wetlands impact, the Consultant was asked to explore a modified realignment of the roadway. Additional studies were required and a successful redesign was accomplished that reduces the mitigation and avoids additional right-of-way acquisition.

• After the original Agreement was executed, the C.3 requirement for clean water went into effect requiring additional stormwater control studies and the preparation of a formal Stormwater Control Plan and Exhibit.

• Redesign of the improvement plan to accommodate the roadway realignment and new stormwater regulations.

• Supplemental topographic survey to identify creek bank, flow lines at critical locations and whether berms, walls or other means will be necessary to contain flows for infiltration.

• Plat plans for right-of-way.

• Non-potable water design plans.

Exhibit A to Amendment No. One describes these additional tasks in greater detail and includes the associated costs for each task.

Staff respectfully requests the approval of Amendment No. One in order to complete the design and move forward with this Project.

FISCAL IMPACT
The amount of Amendment No. One is $36,394, plus a 10% contingency of $3,639.40, for a total amount of $40,033.40. Including Amendment No. One, the Agreement total will become $185,844, plus the 10% contingency, bringing the total amount to $204,428.40, which is within the budgeted design costs of $225,000 in the 2007/08 – 2011/12 CIP Budget.
