RECOMMENDATION
Adopt a Resolution accepting the work performed by K.J. Woods Construction, Inc. for Phase 1 (Utilities) of the Walnut Boulevard Widening, CIP Project No. 336-30560 and directing the City Clerk to file a Notice of Completion with the County Recorder.

PREVIOUS ACTION
On March 28, 2006, by Resolution No. 2006-52, City Council approved the contract documents and authorized the City Manager to execute a construction contract for Phase I (Utilities) of the Walnut Boulevard Widening, CIP Project No. 336-30560 to K.J. Woods Construction, Inc. in the amount of $1,984,000, plus a 10% contingency, for a total amount of $2,182,400.

On June 12, 2007, by Resolution No. 2007-126, City Council adopted the City’s 2007/08 – 2011/12 Capital Improvement Program, which included the Walnut Boulevard Widening, CIP Project No. 336-30560.

BACKGROUND
The City was awarded a grant in the amount of $1,300,000, from the Federal Intermodal Surface Transportation Efficiency Act (“ISTEA”) program, but due to time constraints it was impossible to meet Federal requirements. The Metropolitan Transportation Commission (“MTC”) approved the City’s request to transfer $1,110,000, of these funds to the Brentwood Boulevard Widening, CIP Project No. 336-3054, which was constructed in 2004. The City is obligated, per signed agreement with the State of California, to perform the Walnut Boulevard Widening work. This obligation also includes, having Caltrans review and approve all the contract documents prior to advertising the project for bid.

In the process of obtaining the necessary approvals from Caltrans, the Walnut Boulevard Widening project was split into Phase I (Utilities) and Phase II (Roadway Widening). By splitting the project, it allowed the City to finally move forward and only be required to coordinate and comply with Caltrans requirements for Phase II of the project, and use City Standard requirements for Phase I. Furthermore, the utilities portion of the project is not eligible for federal funding reimbursement.

Phase I (Utilities) of the Walnut Boulevard Widening project started on July 31, 2006. The work included the installation of storm drain lines, water lines, sewer laterals, signal interconnect conduit, fiber optic conduit, street lighting, power, phone, cable, manholes, valves, vaults, transformers and all other appurtenances associated with these utilities, complete and in satisfactory working condition. Some of the overhead facilities such as, electric, Comcast and AT&T were converted from overhead to underground services.
Due to the numerous unknown and unmarked utilities encountered during the underground construction, this project was significantly delayed due to the design being continuously revised to accommodate or relocate utilities. PG&E and AT&T also added to the delay for their design, coordination and eventual conversion of their overhead services to underground. Shallow Chevron pipelines were also encountered. Despite all these delays, Phase I of the project is ready to be accepted and has been completed under budget.

All the improvements for Phase I are complete per the plans and specifications and K.J. Woods Construction, Inc. has met the contractual obligation. Staff is recommending that the work performed by K.J. Woods Construction, Inc. be accepted and that the Notice of Completion be filed with the County Clerk.

FISCAL IMPACT
The total contract amount for the work performed by K.J. Woods Construction, Inc. for Phase I (Utilities) of the Walnut Boulevard Widening, CIP Project No. 336-30560, is as follows:

The final contract amount of $2,035,980 is 6.71% below the City Council approved amount of $2,182,400 and includes two change orders.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE WORK PERFORMED BY K.J. WOODS CONSTRUCTION, INC. FOR PHASE I (UTILITIES) OF THE WALNUT BOULEVARD WIDENING, CIP PROJECT NO. 336-30560 AND DIRECTING THE CITY CLERK TO FILE A NOTICE OF COMPLETION WITH THE COUNTY RECORDER.

WHEREAS, the work included the installation of storm drain lines, water lines, sewer laterals, signal interconnect conduit, fiber optic conduit, street lighting, power, phone, cable, manholes, valves, vaults, transformers and all other appurtenances associated with these utilities; and

WHEREAS, all the improvements for Phase I are complete per the plans and specifications and K.J. Woods Construction, Inc. has met the contractual obligation.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby accept the work performed by K.J. Woods Construction, Inc. for Phase 1 (Utilities) of the Walnut Boulevard Widening, CIP Project No. 336-30560 and direct the City Clerk to file a Notice of Completion with the County Recorder.

NOTICE OF COMPLETION

NOTICE IS HEREBY GIVEN THAT:

THE CITY OF BRENTWOOD, a general law city, in the County of Contra Costa, State of California, did enter into an agreement on March 28, 2006 with K.J. Woods Construction, Inc. for work performed for Phase I (Utilities) for the Walnut Boulevard Widening, CIP Project No. 336-30560.

The work described in the contract documents was to furnish all material, labor, and equipment necessary to complete said work on Walnut Boulevard from Balfour Road to Dainty Avenue in the city of Brentwood.

On the 13th day of November 2007, said contract, as a whole was completed and the work was accepted by the City Council of the City of Brentwood.

I hereby certify under penalty of perjury that the facts set forth in the foregoing Notice of Completion are true and correct.
