Subject/Title: Adopt a Resolution approving and authorizing the City Manager or designee to execute a Professional Services Agreement with Harris & Associates, Inc. for Phase II of the Walnut Boulevard Widening, CIP Project No. 336-30560, in the amount of $32,170, plus a 10% contingency of $3,217, for a total amount of $35,387.

RECOMMENDATION
Adopt a Resolution approving and authorizing the City Manager or designee to execute a Professional Services Agreement with Harris & Associates, Inc., for Phase II of the Walnut Boulevard Widening, CIP Project No. 336-30560, in the amount of $32,170, plus a 10% contingency of $3,217, for a total amount of $35,387.

PREVIOUS ACTION
On June 27, 2000, City Council approved a Professional Services Agreement with Harris and Associates for the design of Walnut Boulevard Widening, CIP Project No. 336-30560, in the amount of $299,566.80.

On March 28, 2006, by Resolution No. 2006-52, City Council approved the contract documents and authorized the City Manager to execute a construction contract for the Walnut Boulevard Widening – Phase I (Utilities), CIP Project No. 336-30560, to K. J. Woods Construction, Inc. in the amount of $1,984,000, plus a 10% contingency, for a total amount of $2,182,400.

On April 10, 2007, by Resolution No. 2007-62, City Council authorized the City Manager to execute a construction contract and necessary documents for the Walnut Boulevard Widening – Phase II (Street), CIP Project No. 336-30560, to Top Grade Construction, Inc. in the amount of $1,794,794, plus a 10% contingency, for a total amount of $1,974,273.40.

On June 12, 2007, by Resolution No. 2007-126, City Council adopted the City’s 2007/08 – 2011/12 Capital Improvement Program, which included the Walnut Boulevard Widening, CIP Project No. 336-30560.

BACKGROUND
Harris & Associates, Inc. provided the design services for the Walnut Boulevard Widening project. In October of 2004, staff contracted with Harris & Associates, Inc. to provide design services / construction management services during the construction phase of the project. The negotiated amount for this service was $45,070.75, and it was anticipated that this budget would carry us through to project completion.

Subsequently, when the Walnut Boulevard Widening project was advertised and bid, it was separated into two phases; Phase I for utility relocation without federal funding and Phase II for street widening involving federal funding. With the separation of the project into two phases and the numerous unknown obstacles found in Phase I, the Harris & Associates’ budget was used exclusively for Phase I of the project.

Now that Top Grade Construction, Inc. has moved into Phase II of the project, it is necessary to have an agreement in place with Harris & Associates, Inc. for the support of the construction aspect of the work. Their experience with the design portion of the project and the construction management of Phase I will add continuity and familiarity with the Phase II work. This budget being requested is sufficient to cover through the completion of the work for Phase II.

Staff is seeking City Council approval for a Professional Services Agreement with Harris & Associates, Inc., for $32,170, plus a 10% contingency of $3,217, for a total amount of $35,387, to provide the necessary support services during the construction of Phase II of the Walnut Boulevard Widening project.

FISCAL IMPACT
There are sufficient funds available in the approved 2007/08 -2011/12 Capital Improvement Program, which includes the Walnut Boulevard Widening, CIP Project No. 336-30560, to accommodate the $32,170, plus a 10% contingency of $3,217, for a total amount of $35,387.
