Subject/Title: Adopt a Resolution accepting the work performed by Manito Construction, Inc. for the Chloramination of Wells, CIP Project No. 562-56170, and directing the City Clerk to file a Notice of Completion with the County Recorder.

RECOMMENDATION
Adopt a Resolution accepting the work performed by Manito Construction, Inc. for the Chloramination of Wells, CIP Project No. 562-56170, and directing the City Clerk to file a Notice of Completion with the County Recorder.

PREVIOUS ACTION
On May 24, 2005, by Resolution No. 2005-115, City Council adopted the City’s 2005/06 – 2009/10 Capital Improvement Program that included the Chloramination of Wells, CIP Project No. 562-56170.

On February 14, 2006, by Resolution No. 2006-29, City Council authorized the construction contract for the Chloramination of Wells, CIP Project No. 562-56170, to Manito Construction, Inc. in the amount of $1,009,350, plus a 10% contingency, for a total amount of $1,110,285, and amended the CIP Budget Sheet to reflect increased industry construction and labor costs.

BACKGROUND
The City has been working on securing a long term treatment option for its surface water supply obtained from the East Contra Costa Irrigation District (“ECCID”). The City has entered into an agreement with the Contra Costa Water District (“CCWD”) to provide interim treatment services of this water and has since purchased existing capacity at the Randall-Bold Water Treatment Plant (“RBWTP”) and is in the process of constructing a new treatment facility adjacent to RBWTP in partnership with CCWD.

In the past, the City used chlorine as its potable water disinfectant for the groundwater pumped from the City’s wells. With the increased volume of surface water being utilized, it became necessary for the City to change the disinfectant used from chlorine to chloramines. Manito Construction, Inc. was awarded a contract in February 2006 to construct seven (7) ammonia chemical injection buildings for this process. All the improvements are complete per the plans and specifications and the Manito Construction, Inc. has met its contractual obligation. Staff is making the recommendation that the work performed by Manito Construction, Inc. be accepted and the Notice of Completion be filed with the County Clerk.

FISCAL IMPACT
The total contract amount for the work performed by Manito Construction, Inc. for the Chloramination of Wells, CIP Project No. 562-56170, is as follows:

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE WORK PERFORMED BY MANITO CONSTRUCTION, INC., FOR THE CHLORAMINATION OF WELLS, CIP PROJECT NO. 562-56170, AND DIRECTING THE CITY CLERK TO FILE A NOTICE OF COMPLETION WITH THE COUNTY RECORDER.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby accept the work performed by Manito Construction, Inc. for the Chloramination of Wells, CIP Project No. 562-56170, and direct the City Clerk to file a Notice of Completion with the County Recorder.

NOTICE OF COMPLETION

NOTICE IS HEREBY GIVEN THAT:

THE CITY OF BRENTWOOD, a general law city, in the County of Contra Costa, State of California, did enter into an agreement on February 14, 2006 with Manito Construction, Inc. for work performed for the Chloramination of Wells, CIP Project No. 562-56170.

The work described in the contract documents was to furnish all material, labor, and equipment necessary to complete said work at various well locations throughout the City of Brentwood.

On the 9th day of October 2007, said contract, as a whole was completed and the work was accepted by the City Council of the City of Brentwood.

I hereby certify under penalty of perjury that the facts set forth in the foregoing Notice of Completion are true and correct.
