Subject/Title: Adopt a Resolution accepting the public water main line constructed by Home Depot, Inc. as part of Lone Tree Plaza, Design Review No. 01-30/Subdivision No. 8515, located at the southeast corner of Lone Tree Way and Heidorn Ranch Road.

RECOMMENDATION
Adopt a Resolution accepting the public water main line constructed by Home Depot, Inc. (“Developer/Contractor”) as part of Lone Tree Plaza, Design Review No. 01-30/Subdivision No. 8515, located at the southeast corner of Lone Tree Way and Heidorn Ranch Road.

PREVIOUS ACTION
On June 26, 2002, by Resolution No. 02-39, Planning Commission approved Design Review No. 01-30 and Subdivision No. 8515, with conditions.

On April 8, 2003, by Resolution No. 2823, City Council approved Final Map Subdivision No. 8515, accepting the improvement securities and approving the Subdivision Improvement and Reimbursement Agreement.

On December 14, 2004, by Resolution No. 2004-285, City Council accepted the Zone II Hydropneumatic Pump Station constructed by Home Depot, Inc. located at the Lone Tree Plaza.

BACKGROUND
This project, located at the southeast corner of Lone Tree Way and Heidorn Ranch Road, was approved for commercial and office space on 76 acres adjacent to the State Highway 4 Bypass. As a part of the project, the Developer/Contractor was conditioned to construct a public water main line necessary to supply water to this large commercial development and to also serve the City’s Northwest Quadrant. At this time the 12” water main line is complete and operational, and has been inspected for conformance with the approved improvement plans. The Developer/Contractor has posted a Maintenance Bond to cover the twelve-month warranty period for the improvements.

The project contains 2,390 LF of 12” PVC water main line and associated appurtenances such as valves, laterals, service connections and meters, to be maintained by the City upon acceptance.

FISCAL IMPACT
Upon acceptance, the City Water Enterprise Fund will incur annual costs associated with necessary maintenance of the water main line.

RESOLUTION NO.

ADOPT A RESOLUTION ACCEPTING THE PUBLIC WATER MAIN LINE CONSTRUCTED BY HOME DEPOT, INC. AS PART OF LONE TREE PLAZA, DESIGN REVIEW NO. 01-30/SUBDIVISION NO. 8515, LOCATED AT THE SOUTHEAST CORNER OF LONE TREE WAY AND HEIDORN RANCH ROAD.

WHEREAS, on June 26, 2002, by Resolution No. 02-39, Planning Commission approved Design Review No. 01-30 and Subdivision No. 8515, with conditions; and

WHEREAS, on April 8, 2003, by Resolution No. 2823, City Council approved Final Map Subdivision No. 8515, accepting the improvement securities and approving the Subdivision Improvement and Reimbursement Agreement; and

WHEREAS, on December 14, 2004, by Resolution No. 2004-285, City Council accepted the Zone II Hydropneumatic Pump Station constructed by Home Depot, Inc. (“Developer/Contractor”) located at the Lone Tree Plaza; and

WHEREAS, the required improvements have been completed and constructed in substantial conformance with the approved improvement plans.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood with respect to Design Review No. 01-30/ Subdivision No. 8515, developed by Home Depot, Inc. that:

1. The 12” public water main line and associated appurtenances are hereby accepted for maintenance.
2. The Improvement Securities will be released within sixty (60) days of the passage of this Resolution.
3. The City Clerk is hereby directed to file this Resolution with the Recorder of Contra Costa County.
