RECOMMENDATION

PREVIOUS ACTION
In March 2, 2004, by Resolution No. 04-9, Planning Commission approved Vesting Tentative Subdivision Map No. 8788, with conditions.

In order for the Final Map to be recorded, the City Manager approved the Subdivision Map, accepted the offers of dedication as shown on the Subdivision Improvement Map, and executed the Subdivision Improvement Agreement for Final Map No. 8388.

On October 11, 2005, City Council was notified through an information Report of the City Manager’s approval of Final Subdivision Map No. 8833, acceptance of improvements securities and approval of the Subdivision Agreement.

BACKGROUND
Subdivision No. 8833 is Phase IV of Tentative Subdivision Map (TSM) No. 8788 and is located on the west side of O’Hara, south of Grant Street and north of Sand Creek Road, will be developed by Brentwood Sand Creek Partners, LLC. (“Developer”) and contains 63 single-family residential lots.

As part of Subdivision No. 8833 improvement plans, as part of the Conditions of Approval requirements, and as part of the Subdivision Improvement Agreement, the Developer has constructed one (1) acre park (Caboose Park) and an asphalt concrete (AC) trail as shown on the Final Map Parcels ‘C’, ‘D’, and ‘E’.

The Developer has installed the following improvement: 2460 lineal feet by 6-8 feet wide of asphalt cement trail along the railroad tracks, fencing between the railroad tracks and trail, one acre park amenities which includes a play area, benches, picnic area, shade components, park fence, irrigation system, turf, trees, ground cover and shrubs. The park and trail improvements are now installed to city standards: therefore, it is appropriate to accept the park and trail improvements as offered in the Final Map

The Developer has provided Maintenance Bonds to cover the twelve-month warranty period for park improvements and trail corridor.
FISCAL IMPACT
Upon acceptance of Caboose Park and adjacent trail improvements, the City will incur annual costs associated with the necessary maintenance of the landscape improvements. The yearly estimated total maintenance cost for the park and trail is $36,500.00 of which $32,500.00 is for the park and $4,000.00 is for the trail. Landscape and Lighting Assessment District No.03-2 has been formed for this subdivision for these costs.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE PARK AND TRAIL OFFERS OF DEDICATION IN-FEE; ACCEPTING RIGHTS SHOWN ON THE FINAL MAP FOR THE PARK AND TRAIL; ACCEPTING PARK AND TRAIL IMPROVEMENTS FOR MAINTENANCE; ACCEPTING THE SUBDIVISON MAITENANCE BONDS FOR SUBDIVISON NO. 8833 ON PARK AND TRAIL, S & S FARMS PHASE IV, LOCATED ON THE WEST SIDE OF O’HARA, SOUTH OF GRANT STREET AND NORTH OF SAND CREEK ROAD.


WHEREAS, in March 2, 2004 and again on May 3, 2005, by Resolution NO. 04-10, Planning Commission approved Tentative Subdivision Map No. 8788, with conditions; and

WHEREAS, on October 11, 2005, City Council was notified through an information Report of the City Manager’s approval of Final Subdivision Map No. 8833, acceptance of improvements securities and approval of the Subdivision Agreement; and

WHEREAS, the required public improvements to the park and trail have been completed and constructed in substantial conformance with the approved improvement plans.

NOW, THERFORE BE IT RESOLVED, that the City Council of the City of Brentwood with respect to Subdivision No. 8833 park and trail improvements, S & S Farms Phase IV, development by Brentwood Sand Creek Partners, LLC. :
1. Offers of dedication in fee simple, as shown on the final map for park Parcel ‘C’ and trail Parcels ‘D’, and ‘E’ are herby accepted.
2. All park and trail corridor improvements for maintenance are hereby accepted for maintenance.
3. The Maintenance Bond to guarantee against defects in material and workmanship for a period of twelve months is hereby accepted.
4. The Subdivision Performance and Payments Bonds for the landscape improvements on Caboose Park and trail apportion of $235,228 are asked to be released in 60 days (60) days of passage of this Resolution.
5. The City Clerk is hereby directed to file Resolution with the Recorder of Contra Costa County.
