Subject/Title: Adopt a Resolution accepting the work performed by William G. McCullough Company for the Non-Potable Water Distribution System – Phase I, CIP Project No. 592-59120, and the Water System Connections / Regulating, CIP Project No. 562-56280, and directing the City Clerk to file a Notice of Completion with the County Recorder.

RECOMMENDATION
Adopt a Resolution accepting the work performed by William G. McCullough Company for the Non-Potable Water Distribution System – Phase I, CIP Project No. 592-59120, and the Water System Connections / Regulating, CIP Project No. 562-56280, and directing the City Clerk to file a Notice of Completion with the County Recorder.

PREVIOUS ACTION
On May 23, 2006, by Resolution No. 2006-126, City Council adopted the City’s 2006/07 – 2010/11 Capital Improvement Program (“CIP”), which included the Non-Potable Water Distribution System – Phase I, CIP Project No. 592-59120, and the Water System Connections / Regulating, CIP Project No. 562-56280.

On April 24, 2007, by Resolution No. 2007-80, City Council awarded the bid, approved and authorized the City Manager or designee to execute a Construction Contract and necessary documents for the Non-Potable Water Distribution System – Phase I, CIP Project No. 592-59120, and the Water System Connections / Regulating, CIP Project No. 562-56280, with William G. McCullough Company, in the amount of $361,343, plus a 10% contingency of $36,134.30, for a total amount of $397,477.30.

BACKGROUND
The Grant Street Non-Potable Waterline Extension is located between Brentwood Boulevard and Cesar Chavez Drive. This project ties into the existing non-potable water main on Sunset Road. This will provide non-potable water for the irrigation of 100 foot wide EBMUD right-of-way landscaping along Grant Street and eliminate the need to use potable water to irrigate that area. This is in continuing efforts by staff to conserve potable water and maximize the use of non-potable water for irrigation. In addition, an 8-inch waterline was connected on Gregory Lane to the main on Brentwood Boulevard.

All the improvements are complete, per the plans and specifications, and the Contractor has met the contractual obligation. Staff is respectfully requesting the acceptance of the work performed by William G. McCullough Company and the Notice of Completion be filed with the County Recorder.

FISCAL IMPACT
The total contract amount for the work performed by William G. McCullough Company for the Non-Potable Water Distribution System – Phase I, CIP Project No. 592-59120, and the Water System Connections / Regulating, CIP Project No. 562-56280, is as follows:

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE WORK PERFORMED BY WILLIAM G. MCCULLOUGH COMPANY FOR THE NON-POTABLE WATER DISTRIBUTION SYSTEM – PHASE I, CIP PROJECT NO. 592-59120, AND THE WATER SYSTEM CONNECTIONS / REGULATING, CIP PROJECT NO. 562-56280, AND DIRECTING THE CITY CLERK TO FILE THE NOTICE OF COMPLETION WITH THE COUNTY RECORDER.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby accept the work performed by William G. McCullough Company for the Non-Potable Water Distribution System – Phase I, CIP Project No. 592-59120, and the Water System Connections / Regulating, CIP Project No. 562-56280, and direct the City Clerk to file a Notice of Completion with the County Recorder

NOTICE OF COMPLETION

NOTICE IS HEREBY GIVEN THAT:

THE CITY OF BRENTWOOD, a general law city, in the County of Contra Costa, State of California, did enter into an agreement on April 24, 2007, with William G. McCullough Company for work performed for the Non-Potable Water Distribution System – Phase I, CIP Project No. 592-59120, and the Water System Connections / Regulating, CIP Project No. 562-56280.

The work described in the contract documents was to furnish all material, labor, and equipment necessary to complete said work located on Grant Street at Brentwood Boulevard in Brentwood, CA 94513.

On the 11th day of September 2007, said contract, as a whole was completed and the work was accepted by the City Council of the City of Brentwood.

I hereby certify under penalty of perjury that the facts set forth in the foregoing Notice of Completion are true and correct.
