Adopt a Resolution accepting the right-of-way offers of dedication in-fee;
accepting easements, abutter’s rights and sub-surface mineral and water
rights as shown on the Final Map; accepting all public improvements for
maintenance; accepting the Subdivision Maintenance Bond and releasing the
Subdivision Improvement Securities for Subdivision No. 8460, Crossroads I,
located south of Sand Creek Road and west of Minnesota Avenue, developed by
On March 20, 2001, by Resolution No. 01-11, Planning Commission approved
Tentative Subdivision Map No. 8461, with conditions.
On September 24, 2002, by Resolution No. 2676, City Council approved Final
Subdivision Map No. 8460, accepting improvement securities and approving a
Subdivision Improvement Agreement.
This subdivision, located south of Sand Creek Road and west of Minnesota
Avenue, has been developed by Ponderosa Homes (“Developer”) and contains 64
single-family residential lots. All public improvements required by the
project’s Conditions of Approval have been constructed and inspected for
conformance with the approved improvement plans including sewer, water and
storm drain lines, sidewalk, paving, streetlights, fiber optic conduit and
landscaping. As a part of this project, the Developer has constructed the
south side of Sand Creek Road widening between Fairview and Minnesota
Avenues and constructed Minnesota Avenue widening south of Sand Creek Road
across the project frontage, including improvements to the intersection of
Sand Creek Road and Minnesota Ave. The Developer has provided Maintenance
Bonds to cover the twelve-month warranty period for all improvements.
As required by the Conditions of Approval and shown on the improvement
plans, the Developer has installed the following improvement quantities:
3,630 Lineal Feet (“LF”) of 8” sewer lines, 3,105 LF of 8” waterlines, 796
LF of 12” waterlines, 2,158 LF of various diameter storm drains, 43,097 LF
of 5’ wide sidewalk, 3,880 LF of pavement, 7,453 LF of curb and gutter, 23
streetlights, 3,700 LF of fiber optic conduit and 83,636 Square Feet (“SF”)
of landscaping and irrigation.
When the Final Map was approved by the City Council, the right-of-way offers
of dedication were accepted subject to acceptance of improvements. The
improvements are now installed to support the new lots; therefore, it is the
appropriate time to accept the improvements, rights-of-way and easements as
offered on the Final Map.
Upon acceptance of improvements the City will incur annual costs associated
with necessary maintenance of streets, landscaping and utilities. Routine
roadway maintenance will be funded by the General Fund and Measure “C”
transportation sales tax, with sewer and water maintenance funded through
their respective enterprise funds. Landscaping and Lighting Assessment
District (“LLD”) No. 99-3, has been formed for this subdivision and will be
responsible for the street lighting and landscape maintenance.

RIGHT-OF-WAY OFFERS OF DEDICATION IN-FEE; ACCEPTING EASEMENTS, ABUTTER’S
RIGHTS AND SUB-SURFACE MINERAL AND WATER RIGHTS AS SHOWN ON THE FINAL MAP;
ACCEPTING ALL PUBLIC IMPROVEMENTS FOR MAINTENANCE; ACCEPTING THE SUBDIVISION
MAINTENANCE BOND AND RELEASING THE SUBDIVISION IMPROVEMENT SECURITIES FOR
SUBDIVISION NO. 8460, CROSSROADS I, LOCATED SOUTH OF SAND CREEK ROAD AND
WEST OF MINNESOTA AVENUE, DEVELOPED BY PONDEROSA HOMES.
WHEREAS, on March 20, 2001, by Resolution No. 01-11, Planning Commission
approved Tentative Subdivision Map No. 8461, with conditions; and
WHEREAS, on September 24, 2002, by Resolution No. 2676, City Council
approved Final Subdivision Map No. 8460, accepting improvement securities
and approving a Subdivision Improvement Agreement; and
WHEREAS, the required public improvements have been completed and
constructed in substantial conformance with the approved improvement plans.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood
with respect to Subdivision No. 8460, Crossroads I, developed by Ponderosa

3. The Maintenance Bond to guarantee against defects in material and

sixty (60) days of the passage of this Resolution.
5. The City Clerk is hereby directed to file this Resolution with the
Recorder of Contra Costa County.
