Subject/Title: Adopt a Resolution approving and authorizing the City Manager to execute revised Funding Agreement PS0624 in the amount of $205,899 between the City of Brentwood and the California Office of Traffic Safety for the Pedestrian and Bicycle Safety Program

RECOMMENDATION
Adopt a Resolution approving and authorizing the City Manager to execute revised Funding Agreement PS0624 in the amount of $205,899 between the California Office of Traffic Safety and the City of Brentwood for the Pedestrian and Bicycle Safety Program.

PREVIOUS ACTION
On September 13, 2005 Council adopted Resolution 2005-221 authorizing the City Manager to execute Funding Agreement PS0624 between the California Office of Traffic Safety and the City of Brentwood in the amount of $138,275 for the Pedestrian and Bicycle Safety Program.

BACKGROUND
The California Office of Traffic Safety (OTS) makes funds available to local government for the purposes of reducing vehicle, bicycle and pedestrian collisions, and making public roadways safer. OTS bases funding on the magnitude and severity of the problems identified, and availability of funds.

Because of the need shown by the OTS ranking, a “concept paper” was submitted by staff of the Engineering and Finance Departments requesting a grant in the amount of $83,923.76 for a second phase of the Bicycle and Pedestrian Safety Program. There were funds remaining in the original grant of $138,275 awarded in 2005 for the first phase and staff received permission to retain those funds and combine them with the award made this year. The total of both grants for the Bicycle and Pedestrian Safety Program is now $205,899.

The grant will provide funding to increase safety awareness among pedestrians, bicyclists and motorists using education, enforcement and engineering. The program will include overtime hours for Police and Community Service Officer for bike patrol, education and enforcement and a bicycle rodeo. It will also include educational material, awards and incentives and bicycle helmets for students. A speed monitoring radar trailer, hand-held radar guns, traffic signal monitoring equipment, and LED traffic signs will also be purchased and installed.

FISCAL IMPACT
None. The total amount of the award is now $205,899. There is no matching requirement for this grant.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING AND AUTHORIZING THE CITY MANAGER TO EXECUTE REVISED FUNDING AGREEMENT PS0624 IN THE AMOUNT OF $205,899 WITH THE OFFICE OF TRAFFIC SAFETY FOR ALLOCATION OF FUNDS FOR THE PEDESTRIAN AND BICYCLE SAFETY PROGRAM

WHEREAS, the Office of Traffic Safety (OTS) administers a federal grant program using federal funds apportioned to California under the National Highway Safety Act and the Transportation Equity Act for the 21st Century (TEA-21) for programs designed to reduce deaths, injuries and economic losses resulting from traffic related collisions; and

WHEREAS, OTS solicits project proposals from each region for this program each winter for implementation beginning in the following Federal fiscal year; and

WHEREAS, the City of Brentwood recognizes the traffic safety risks that children face while bicycling and on foot; and

WHEREAS, based on the concept paper submitted for the City of Brentwood Pedestrian and Bicycle Safety Program OTS approved Funding Agreement PS0624 for the project in the amount of $138,275 for the period from October 1, 2005 to September 30, 2008; and

WHEREAS, a second concept paper was submitted to continue the Bicycle and Pedestrian Safety Program and OTS has awarded funding, and

WHEREAS, the grant will remain under Funding Agreement number PS0624 and will combine funds remaining from the first award with the second award for a new total of $205,899, and

WHEREAS, the revised effective dates of the agreement are now October 1, 2005 / September 30, 2008; and

WHEREAS, a resolution is necessary to authorize the revised funding agreement and designate the person authorized to execute the agreement as the City’s representative.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that

1. Up to $205,899 in OTS grant funding for the period from October 1, 2005 to September 30, 2008 is authorized to be accepted and expended.
2. The City Manager is designated as the City’s authorized representative to execute the necessary documents for this grant program.
3. This Resolution will be effective upon adoption.
