Subject/Title: Adopt a resolution of the City Council of the City of Brentwood approving the Public Art Design and Concept by Bryant Tedrick for Public Art Element in the Primary Park in the Barrington Development by Standard Pacific Homes, Subdivision #8548

RECOMMENDATION
Adopt a resolution of the City Council of the City of Brentwood approving the Public Art Design and Concept by Bryant Tedrick for Public Art Element in the Primary Park in the Barrington Development by Standard Pacific Homes, Subdivision #8548.

PREVIOUS ACTION
On September 9, 2003, City Council approved Section 2.44.180 Public Art and on September 23, 2003 approved the fee schedule committing one percent of the cost of capital investment projects to art and four tenths of one percent for housing development which became effective on July 1, 2004.

BACKGROUND
The public art element for this project is a large kinetic found object fish sculpture, approximately 21 feet long.

On November 17, 2006 the selection panel for Barrington met to select finalists for the public art project. The panel consisted of: Cindy Brown and Amy Maley from Standard Pacific Homes (the developer), Matt Bauwens the Landscape Architect for the development, and Joe Trebino and Ron Beatty, both from the Public Art Committee. The panel selected three finalists: Pam Beyette from Seattle, Troy Corliss from Truckee, and Bryan Tedrick from Glen Ellen. An alternate, Dayton Claudio from Chico was also selected. On January 4, 2007 Pam Beyette dropped out of the competition and Dayton Claudio replaced her as a finalist.

On February 23, 2007 the selection panel met a second time to receive the proposals developed by the three artists. Aaron Ross Swain served on this second phase selection panel in place of Cindy Brown and Amy Maley from Standard Pacific Homes. The selection panel unanimously recommended Dayton Claudio to the Public Art Committee for the Barrington public art project. Mr. Claudio’s proposal included a number of items that were already budgeted. Since these items would now be covered under the public art budget there was enough of a construction savings to include another public art element. The selection panel chose one of the sculptures presented by Bryan Tedrick.

On April 10, 2007 the Public Art Committee unanimously approved the project designs and concepts for recommendation to the Arts Commission.

On June 27, 2007 the Arts Commission approved the project designs and concepts for recommendation to the Public Art Subcommittee.
On July 17, 2007 the Public Art Subcommittee unanimously approved the project designs and concepts for recommendation to the City Council.

The artist, Bryan Tedrick, will be available to present the design concept renderings and proposed materials at the August 14, 2007 meeting, should there be any questions.

FISCAL IMPACT
There is no fiscal impact to the City of Brentwood as the artist is contracted directly with the developers, Standard Pacific Homes.

The percent for art requirement on residential projects is 4/10s of 1% of the building valuation. Of that, 80% of that goes to fund the artwork, 20% funds administration of the public art program.

The proposed public art elements in the Barrington development will be maintained through the Lighting Landscape District (LLD). Maintenance is estimated at $5,000 annually.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING THE PUBLIC ART DESIGN AND CONCEPT BY BRYAN TEDRICK FOR PUBLIC ART ELEMENT IN THE PRIMARY PARK IN THE BARRINGTON DEVELOPMENT BY STANDARD PACIFIC HOMES, SUBDIVISION #8548.

WHEREAS, On September 9, 2003, City Council approved Section 2.44.180 Public Art and on September 23, 2003 approved the fee schedule committing one percent of the cost of capital investment projects to art and four tenths of one percent for housing development which became effective on July 1, 2004; and

WHEREAS, On February 23, 2007 the selection panel chose one of the sculptures presented by Mr. Tedrick; and

WHEREAS, On April 10, 2007 the Public Art Committee unanimously approved the project designs and concepts for recommendation to the Arts Commission; and

WHEREAS, On June 27, 2007 the Arts Commission approved the project designs and concepts for recommendation to the Public Art Subcommittee; and

WHEREAS, On July 17, 2007 the Public Art Subcommittee unanimously approved the project designs and concepts for recommendation to the City Council.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Brentwood approves Public Art Design and Concept by Bryan Tedrick for Public Art Element in the Primary Park in the Barrington Development by Standard Pacific Homes, Subdivision #8548.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting held on the 14th day of August 2007 by the following vote:
