RECOMMENDATION
Adopt a resolution of the City Council of the City of Brentwood approving the Public Art Design and Concept by Vickie Sowell for Public Art Elements at King Park for CIP Project No. 352-52404.

PREVIOUS ACTION
On September 9, 2003, City Council approved Section 2.44.180 Public Art and on September 23, 2003 approved the fee schedule committing one percent of the cost of capital investment projects to art and four tenths of one percent for housing development which became effective on July 1, 2004. If the developer opts to pay the in lieu fee at five tenths of one percent the money goes into the Municipal Art Fund to be expended on public art by commission or direct purchase.

BACKGROUND
The two public art elements for this project include: a life size dog placed at the entrance to the dog park and a large scale piece along Sand Creek Road.

On February 7, 2006 the Public Art Committee approved $45,000 for a public art element at King Park, the new dog park in Brentwood off of Sand Creek Rd., between Minnesota and Fairview. The Arts Commission approved this as a project and the budget on March 22, 2006.

On December 19, 2006 the selection panel for King Park met to select finalist for the project. The panel consisted of: Lt. Kevin King; Dr. Schnittker, a local veterinarian; and Tommy Wernholm and Patrick McCarran, both from the Public Art Committee. Jan Melloni from the Parks and Recreation Commission was scheduled to be on the panel as well, but at the last minute was unable to attend. The panel selected four finalists, Scott Donahue from Emeryville, Larry Meeks from Sacramento, Vickie Sowell from Emeryville, and Bryan Tedrick from Glen Ellen.

February 9th staff met with the artists for a site tour in order to familiarize themselves with the park, and the plans. All the artists attended, with the exception of Larry Meeks. On February 13, 2007 Scott Donahue dropped out of the competition leaving three finalists as there was no alternate.

• On March 23, 2007 the selection panel met a second time to receive the proposal developed by the three artists. The selection panel unanimously recommended Vickie Sowell to the Public Art Committee for the King Park dog park public art project.
• On May 1, 2007 the Public Art Committee unanimously approved the project design and concept for recommendation to the Arts Commission.
• On May 23, 2007 the Arts Commission approved the project design and concept for recommendation to the Public Art Subcommittee.
• On July 17, 2007 the Public Art Subcommittee unanimously approved the project design and concept for recommendation to the City Council.
The artist, Vickie Sowell, will be available to present the design concept renderings and proposed materials at the August 14, 2007 meeting, should there be any questions.

FISCAL IMPACT
The cost for this public art project is $45,000. This will come out of the municipal art fund 268 from CIP Project No. 352-52404 which has been included in the 2007/08 – 2011/12 CIP Budget.

The proposed public art element will be maintained through the park maintenance fees and will be minimal, estimated at $500 annually.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING THE PUBLIC ART DESIGN AND CONCEPT BY VICKIE SOWELL FOR PUBLIC ART ELEMENTS AT KING PARK FOR CIP PROJECT NO. 352-52404

WHEREAS, On September 9, 2003, City Council approved Section 2.44.180 Public Art and on September 23, 2003 approved the fee schedule committing one percent of the cost of capital investment projects to art and four tenths of one percent for housing development which became effective on July 1, 2004; and

WHEREAS, On March 23, 2007 the selection panel unanimously chose Ms. Sowell to the Public Art Committee for the King Park dog park public art project; and

WHEREAS, On May 1, 2007 the Public Art Committee unanimously approved the project designs and concepts for recommendation to the Arts Commission; and

WHEREAS, On May 23, 2007 the Arts Commission approved the project designs and concepts for recommendation to the Public Art Subcommittee; and

WHEREAS, On July 17, 2007 the Public Art Subcommittee unanimously approved the project designs and concepts for recommendation to the City Council.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Brentwood approves Public Art Design and Concept by Vickie Sowell for Public Art Element at King Park for CIP Project No. 352-52404.
