Subject/Title: Adopt a Resolution accepting all off-site public improvements for maintenance and releasing the Improvement Securities for Design Review No. 04-16, developed by Thorpe Design, located in the Sunset Industrial Complex.

RECOMMENDATION
Adopt a Resolution accepting all off-site public improvements for maintenance and releasing the Improvement Securities for Design Review No. 04-16, developed by Thorpe Design (“Developer”), located in the Sunset Industrial Complex.

PREVIOUS ACTION
On August 3, 2004, by Resolution No. 04-51, Planning Commission approved Design Review No. 04-16, with conditions.

BACKGROUND
This project, located at the southeast corner of Elkins Way and Beatrice Court in the Sunset Industrial Complex, was approved for an 18,265 square foot industrial building. All improvements required by the Conditions of Approval for this project, such as curb, gutter, sidewalk, paving and utility connections, have been constructed and inspected for conformance with the approved improvement plans.

As a part of the project the Developer has installed the following improvement quantities: 453 Lineal Feet (LF) of 6” sewer lines, 157 LF of waterlines, 453 LF of 6” diameter storm drain lines, 2,176 Square Feet (SF) of concrete walk, 45,764 SF of asphalt pavement and 4,750 SF of landscaping and irrigation.

With the improvements now installed to the satisfaction of the City, it is the appropriate time to accept the improvements and begin the warranty period.

FISCAL IMPACT
Most of the improvements associated with this project are privately owned and maintained; therefore, upon acceptance the City will incur only minimal annual costs associated with necessary maintenance of the public paving and concrete. Routine roadway maintenance will be funded by the General Fund and Measure “C” transportation sales tax, with sewer and water maintenance funded through their respective enterprise funds. Landscaping and Lighting Assessment District (LLD) No. 02-12 has been formed for this subdivision and will be responsible for the street lighting and landscape maintenance in public areas.

RESOLUTION NO.


A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING ALL OFF-SITE PUBLIC IMPROVEMENTS FOR MAINTENANCE AND RELEASING THE IMPROVEMENT SECURITIES FOR DESIGN REVIEW NO. 04-16, DEVELOPED BY THORPE DESIGN, LOCATED IN THE SUNSET INDUSTRIAL COMPLEX.


WHEREAS, on August 3, 2004, by Resolution No. 04-51, Planning Commission approved Design Review No. 04-16, with conditions; and

WHEREAS, the required improvements have been completed and constructed in substantial conformance with the approved improvement plans.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood with respect to Design Review No. 04-16, developed by Thorpe Design that:

1. All off-site public improvements are hereby accepted for maintenance.
2. The Improvement Securities will be released within sixty (60) days of the passage of this Resolution.
3. The City Clerk is hereby directed to file this Resolution with the Recorder of Contra Costa County.
