RECOMMENDATION

Adopt a Resolution Approving and Authorizing the City Manager to Execute a Ratification of Amendment No. One to Extend and Amend the Contract with the Highway 4 Bypass Authority for Law Enforcement Services
PREVIOUS ACTION

On July 13, 2004, the City Council approved the contract with the Highway 4 Bypass Authority for Law Enforcement services.

BACKGROUND
The California State Highway Patrol will ultimately police this facility, but will only do so after the full acceptance of the entire length of the Highway 4 Bypass by the State, which will be after the completion of Segments 1 and 3. Until that time, the City will need to enforce the Vehicle Code and public safety issues since it is within the City’s jurisdiction. The original contract ended July 13, 2006, however, the City has continued to bill and be paid at the original rate. The ratification of amendment continues the Agreement through June 2009 and increases the payment by 6.5% to $7,029 per quarter. The 6.5% increase represents the average personnel increase for Brentwood Police Officers for 2007/2008

FISCAL IMPACT
This ratification of amendment will enable the City to continue to be reimbursed for the costs associated with the Police services on the Highway 4 Bypass.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING AND AUTHORIZING THE CITY MANAGER TO EXECUTE A RATIFICATION OF AMENDMENT TO EXTEND AND AMEND THE CONTRACT WITH THE HIGHWAY 4 BYPASS AUTHORITY FOR LAW ENFORCEMENT SERVICES


WHEREAS, on July 13, 2004, the City Council approved a contract with the Highway 4 Bypass Authority to provide police services between Balfour Road and Lone Tree Way along the Highway 4 Bypass route; and

WHEREAS, the original contract ended July 13, 2006 and the City Council desires to ratify the amendment to continue the Agreement through June 2009; and

WHEREAS, the California State Highway Patrol will not accept enforcement responsibility until the State of California accepts the roadway, which will occur after the completion of Segments 1 and 3; and

WHEREAS, the Brentwood Police Department is the obvious enforcement authority due to the roadway being entirely within the City limits of the City of Brentwood.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood approves and authorizes the City Manager to execute a ratification of amendment to extend and amend the contract with the Highway 4 Bypass Authority for Law Enforcement Services, a copy of which is attached hereto as Exhibit “A”.
