Subject/Title: Adopt a Resolution ratifying, approving and authorizing the City Manager to execute, Amendment No. Five to the Professional Services Agreement with William J. Silva, P.E., for Engineering Support Services.

RECOMMENDATION
Adopt a Resolution ratifying, approving and authorizing the City Manager to execute, Amendment No. Five to the Professional Services Agreement with William J. Silva, P.E., on an as-needed basis for engineering services.

PREVIOUS ACTION
On August 19, 2004, the City of Brentwood entered into a Professional Services Agreement with William J. Silva, P.E., to obtain Transportation Engineering Services on an as-needed basis through December 31, 2004.

On December 20, 2004, Amendment No. One to the Professional Services Agreement with William J. Silva, P.E., was entered into to extend the contract termination date until June 30, 2005, for Transportation Engineering Services on an as-needed basis.

On June 14, 2005, by Resolution No. 2005-136, City Council authorized the City Manager to execute Amendment No. Two to the Professional Services Agreement with William J. Silva, P.E., to extend the contract termination date until December 31, 2005, and increased the fee of $75.00 per hour to $80.00 per hour, for Transportation Engineering Services on an as-needed basis.

On December 13, 2005, by Resolution No. 2005-290, City Council authorized the City Manager to execute Amendment No. Three to the Professional Services Agreement with William J. Silva, P.E., to extend the contract termination date until June 30, 2006, to provide Transportation Engineering Services on an as-needed basis.

On June 27, 2006, by Resolution No. 2006-152, City Council authorized the City Manager to execute Amendment No. Four to the Professional Services Agreement with William J. Silva, P.E. altering the Agreement’s scope of work to provide Development Engineering Services (in lieu of Transportation Engineering Services), increase the fee of $80.00 per hour to $90.00 per hour, for the Engineering Division of the Public Works Department including, but not limited to, plan check and other related services, for the City of Brentwood.

BACKGROUND
William J. Silva, P.E., has provided consultant engineering support services to the Engineering Division of the Public Works Department since August of 2004. He has provided traffic engineering support services through February of 2006 while the City was recruiting for a Traffic Engineering Manager. Subsequently, he has provided engineering support services to the Development Division while the City was recruiting for a Development Engineering Manager. As both of these positions have been filled, other vacant positions within the CIP Section have arisen causing the need for additional temporary staff. Mr. Silva is available to provide project management and coordination services for review of plans prepared for construction of capital improvement program projects, and assist with the construction management of projects for which contracts are awarded for construction.

Staff has been very satisfied with William J. Silva’s previous professional work performance. Based on his experience with the City’s street system, water and wastewater systems and storm drainage facilities, as well as his expertise in managing construction projects, staff feels that he is more than qualified to work as an Engineer on Capital Improvement Program Projects.

FISCAL IMPACT
Since August 2004, William J. Silva, P.E., has received $111,345, for transportation services out of the transportation budget under the Engineering Division of the Public Works Department. Approximately $100,000 was expended for Development Engineering Services during the period of time the division was without an Engineering Manager and William J. Silva, P.E. served in that capacity. With the omission of a current Sr. Associate Engineer in the CIP Section, there are sufficient funds in the 2006/07 Operating Budget and the proposed 2007/08 Operating Budget, which is being considered tonight.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD RATIFYING, APPROVING AND AUTHORIZING THE CITY MANAGER TO EXECUTE, AMENDMENT NO. FIVE TO THE PROFESSIONAL SERVICES AGREEMENT WITH WILLIAM J. SILVA, P.E., ON AN AS-NEEDED BASIS FOR ENGINEERING SERVICES.
