RECOMMENDATION
Adopt a Resolution adopting the Mitigated Negative Declaration and Mitigated Monitoring Reporting Plan for the John Muir Parkway Extension, CIP Project No. 336-31640.

PREVIOUS ACTION
On May 23, 2006, by Resolution No. 2006-126, City Council adopted the City’s 2006/07 – 2010/11 Capital Improvement Program (CIP), which included the John Muir Parkway Extension, CIP Project No. 336-31640.

On June 13, 2006, by Resolution No. 2006-130, City Council approved a contract with Bellecci and Associates to provide design and construction support for the John Muir Parkway Extension – Phase I, CIP Project No. 336-31640, in an amount of $149,450, plus a 10% contingency, for a total amount of $164,395.

BACKGROUND
This project will replace the existing Concord Avenue west of its existing location by extending John Muir Parkway Extension from Ventura Drive to Briones Valley Road. The relocation is required due to the construction of Segment 3 of State Route 4 Bypass (“Bypass”) which will displace this portion of Concord Avenue. Construction of Segment 3 is underway and is scheduled to be completed in 2008.

The project will construct approximately 2,450 feet of roadway from Ventura Avenue to Briones Valley Road, including 550 feet of Foothill Drive from Pearson Drive to John Muir Parkway Extension. The project will provide two travel lanes, a center median, a bike lane, five feet of sidewalk and curb and gutter. The project will not increase roadway capacity from what presently exists.

Two consultants were hired to assist in the environmental approval process. July 11, 2006, Circle Point was hired as the environmental consultant for this project. On March 9, 2007 RCL Ecology was hired as the biological and permitting consultant to assist in permits from other jurisdictional agencies.

Circle Point prepared the Initial Study (“IS”)/Mitigated Negative Declaration (“MND”) in accordance with the California Environmental Quality Act (“CEQA”), which requires state and local government agencies to consider the environmental consequences of the proposed project. The intent of the IS/MND is to provide information concerning any potential environmental effects of the proposed project and to indicate possible ways to reduce or avoid potential significant effects. The IS/MND was circulated for public and affected regulatory agencies review from April 10, 2007 to May 9, 2007. Comments were received from Caltrans and Contra Costa Flood Control District. The comments were considered and the appropriate changes have been made prior to finalizing the IS/MND.

FISCAL IMPACT
This is an administrative function with no fiscal impact to the project; however, some permit fees have been identified and funds associated with this work have been included in the adopted 2006/07 – 2010/11 Capital Improvement Program, which includes the John Muir Parkway Extension, CIP Project No. 336-31640.

RESOLUTION NO.


A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ADOPTING THE MITIGATED NEGATIVE DECLARATION AND MITIGATED MONITORING REPORTING PLAN FOR THE JOHN MUIR PARKWAY EXTENSION, CIP PROJECT NO. 336-31640.


WHEREAS, on May 23, 2006, by Resolution No. 2006-126, City Council adopted the City’s 2006/07 – 2010/11 Capital Improvement Program (CIP), which included the John Muir Parkway Extension, CIP Project No. 336-31640; and

WHEREAS, these improvements would not increase roadway capacity from what presently exist; and

WHEREAS, a Mitigated Negative Declaration and Mitigated Monitoring Reporting Plan was prepared in conformation with California Environmental Quality Act, comments have been solicited from the public and affected regulatory agencies and two agency comments were received, considered and appropriate changes made.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby adopt the Mitigated Negative Declaration and Mitigated Monitoring Reporting Plan for the John Muir Parkway Extension, CIP Project No. 336-31640 and make the following findings:

1. On the basis of the whole record there is no substantial evidence that the project will have a significant effect on the environment; and
2. The Mitigated Negative Declaration reflects the City of Brentwood’s independent judgment and analysis; and
3. The City is the custodian of the documents and other records which constitute the record of proceedings upon which this decision is based, which documents and other materials are located at the City of Brentwood, 150 City Park Way, Brentwood, CA 94513.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting held on the 12th day of June 2007 by the following vote:
