Subject/Title: Adopt a Resolution approving and authorizing the City Manager or designee to execute a Streambed Alteration Agreement with California Department of Fish and Game for the Central Boulevard Bridge widening over Marsh Creek between Dainty Avenue and Griffith Lane.

RECOMMENDATION
Adopt a Resolution approving and authorizing the City Manager or designee to execute a Streambed Alteration Agreement (“Agreement”) with California Department of Fish and Game (“CDFG”) for the Central Boulevard Bridge widening over Marsh Creek between Griffith Lane and Dainty Avenue.

PREVIOUS ACTION
On January 18, 2005, by Resolution No. 04-86, Planning Commission of the City of Brentwood approved Tentative Subdivision Map No. 8729, developed by PBP Limited Partnership, a California Limited Partnership (Pinn Bros.), which included Conditions of Approval Item No. 4, requiring the Central Boulevard widening between Griffith Lane to Dainty Avenue, including widening of the Bridge over Marsh Creek.

On February 22, 2005, by Resolution No. 2005-49, City Council certified the Environmental Impact Report and adopted the accompanying Mitigation Monitoring Plan and approved Tentative Subdivision Map No. 8729.

On May 23, 2006, by Resolution No. 2006-126, City Council adopted the City’s 2006/07 – 2010/11 Capital Improvement Program (“CIP”), which included the Central Boulevard Widening Project, as part of Developer Improvements.

BACKGROUND
Central Boulevard, per the City’s Roadway Master Plan, is required to be a four lane arterial road. Per the Conditions of Approval for Subdivision No. 8729, Pinn Bros. (“Developer”) is required to construct a new bridge over Marsh Creek and widen Central Boulevard.

Prior to the Developer beginning construction of the bridge over Marsh Creek, the City is required to enter into an agreement with the CDFG. The conditions of the Agreement are standard for this type of work. The Agreement with CDFG requires payment of $19,191, for the Marsh Creek Channel Impact, which will be paid by the Developer. As the improvements are off-site, the Developer will be reimbursed for all construction cost related to this portion of the project. The project will be constructing approximately 100 foot long, 40 foot wide cast-in-place clear span bridge structure.

FISCAL IMPACT
The project will be constructed by the Developer as per their Condition of Approval; however, the costs of the off-site improvements will be included in the Developer’s future reimbursement agreement per the Development Fee Program. This project will increase pavement management. The annual operating and maintenance for the roadway and utility work is estimated to be $18,785.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING AND AUTHORIZING THE CITY MANAGER OR DESIGNEE TO EXECUTE A STREAMBED ALTERATION AGREEMENT (“AGREEMENT”) WITH CALIFORNIA DEPARTMENT OF FISH AND GAME (“CDFG”) FOR THE CENTRAL BOULEVARD BRIDGE WIDENING OVER MARSH CREEK BETWEEN GRIFFITH LANE AND DAINTY AVENUE.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting held on the 12th day of June 2007 by the following vote:
