Prepared by: Debra Galey, Management Analyst

RECOMMENDATION
Adopt a Resolution accepting all public improvements for maintenance; accepting the Subdivision Maintenance Bond; and releasing the Subdivision Improvement Securities for Subdivision No. 8675, Rose Garden Phase II, located north of Lone Tree Way and south of Neroly Road, developed by Pulte Homes (“Developer”).

PREVIOUS ACTION
On September 23, 2003, by Resolution No. 03-72, Planning Commission approved Tentative Subdivision Map No. 8561, with conditions.

On February 8, 2005, City Council was notified through an Informational Report of the City Manager’s approval of Final Subdivision Map No. 8675, acceptance of improvement securities and approval of the Subdivision Improvement Agreement.

BACKGROUND
This subdivision, located north of Lone Tree Way and south of Neroly Road, contains 230 single-family residential lots. The improvements for this subdivision have been constructed and inspected for conformance with the approved improvement plans including sewer, water and storm drain lines, sidewalk, paving, streetlights and fiber optics. As a part of this project, Pulte Homes has widened Lone Tree Way and Neroly Road and constructed 2.6 acres of parks and a trail along the west and north boundaries of the project. Pulte Homes has provided a Maintenance Bond to cover the twelve-month warranty period for all public improvements.

As required by the Conditions of Approval and shown on the improvement plans, the Developer has installed the following improvement quantities: 8,470 linear feet (LF) of 8” sewer lines, 9,870 LF of 8” waterlines, 7,960 LF of 18” to 30” storm drain lines, 18,910 LF of curb and gutter, 16,164 LF of sidewalk, 11,474 LF of pavement, 60 streetlights, 9,870 LF of joint trench including fiber optic conduit, 349,850 square feet (SF) of landscaping and irrigation and 47,520 LF of 12’ asphalt trail.

The necessary right-of-way offers of dedication and easements required for maintenance of the public improvements were offered to the City and accepted as a part of the final map. With the improvements now installed to support the new lots, it is the appropriate time to accept the improvements and begin the warranty period.

FISCAL IMPACT
Upon acceptance of improvements the City will incur annual costs associated with necessary maintenance of streets, landscaping and utilities. Routine roadway maintenance will be funded by the General Fund and Measure “C” transportation sales tax, with sewer and water maintenance funded through their respective enterprise funds. Landscaping and Lighting Assessment District (LLD) No. 03-2 has been formed for this subdivision and will be responsible for the street lighting and landscape maintenance in public areas.
