Subject/Title: Adopt a Resolution accepting the work performed by Tidelands Construction Company for the Surface Water Treatment Facility – Phase I, CIP Project No. 562-56290 and directing the City Clerk to file a Notice of Completion with the County Recorder.

RECOMMENDATION
Adopt a Resolution accepting the work performed by Tidelands Construction Company for the Surface Water Treatment Facility – Phase I, CIP Project No. 562-56290 and directing the City Clerk to file a Notice of Completion with the County Recorder.

PREVIOUS ACTION
On December 14, 1999, by Resolution No. 99-254, City Council approved the agreements between East Contra Costa Irrigation District (“ECCID”), Contra Costa Water District (“CCWD”) and the City of Brentwood for long-term water supply, conveyance and treatment.

On August 12, 2003, by Resolution No. 2949, City Council authorized the City Manager to execute the amendment to the agreement with the Contra Costa Water District pertaining to treated water services.

On August 24, 2004, by Resolution No. 2004-206, City Council authorized the City Manager to execute an agreement with the Contra Costa Water District pertaining to long term treated water services as a part of the Surface Water Treatment Facility - Phase II, CIP Project No. 562-56290.

On December 14, 2004, by Resolution No. 2004-283, City Council authorized the City Manager to execute a Professional Services Agreement with The Covello Group, Inc. to provide construction management assistance for the Surface Water Treatment Facility – Phase I, CIP Project No. 562-56290.

On January 25, 2005, by Resolution No. 2005-23, City Council awarded the construction contract for the Surface Water Treatment Facility – Phase I, CIP Project No. 562-56290, to Tidelands Construction Company and authorized the City Manager to execute the agreement and necessary documents in the amount of $7,858,130, plus a 5% contingency.

BACKGROUND
As a part of the analysis for the long term delivery of treated water to the City of Brentwood, a pipeline and pump station were needed to deliver treated water from the Randall Bold Water Treatment Plant (“RBWTP”), as well as the proposed treatment facility adjacent to RBWTP. However, it was concluded that this pipeline and pump station (“Phase I”) should be constructed right away to provide reliable and sufficient pumping and distribution capacity for the immediate delivery of water from the purchased treatment capacity in the existing RBWTP.

The City of Brentwood advertised the Surface Water Treatment Facility – Phase I project beginning on December 3, 2004 and bids were opened on January 18, 2005. Tidelands Construction Company was awarded the construction contract on January 25, 2005. Phase II (construction of a new water treatment facility with CCWD) is currently under construction with an anticipated completion of mid-to-late 2008.

All the improvements for Phase I are complete, per the plans and specifications, and the Contractor has met the contractual obligation. Staff is respectfully requesting the acceptance of the work performed by Tidelands Construction Company and that the Notice of Completion is filed with the County Recorder.

FISCAL IMPACT
The total contract amount for the work performed by Tidelands Construction Company for the Surface Water Treatment Facility – Phase I, CIP Project No. 562-56290, is as follows:

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE WORK PERFORMED BY TIDELANDS CONSTRUCTION COMPANY FOR THE SURFACE WATER TREATMENT FACILITY – PHASE I, CIP PROJECT NO. 562-56290 AND DIRECTING THE CITY CLERK TO FILE THE NOTICE OF COMPLETION WITH THE COUNTY RECORDER.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby accept the work performed by Tidelands Construction Company for the Surface Water Treatment Facility – Phase I, CIP Project No. 562-56290 and direct the City Clerk to file a Notice of Completion with the County Recorder

NOTICE OF COMPLETION

NOTICE IS HEREBY GIVEN THAT:

THE CITY OF BRENTWOOD, a general law city, in the County of Contra Costa, State of California, did enter into an agreement on January 25, 2005 with Tidelands Construction Company for work performed for the Surface Water Treatment Facility – Phase I, CIP Project No. 562-56290.

The work described in the contract documents was to furnish all material, labor, and equipment necessary to complete said work located adjacent to the Randall Bold Water Treatment Plant, 3760 Neroly Road, Oakley, CA 94561.

On the 22nd day of May 2007, said contract, as a whole was completed and the work was accepted by the City Council of the City of Brentwood.

I hereby certify under penalty of perjury that the facts set forth in the foregoing Notice of Completion are true and correct.
