Subject/Title: Adopt a Resolution awarding the bid and approving and authorizing the City Manager or designee to execute a Construction Contract and necessary documents for the American Avenue Improvements, CIP Project No. 336-31681, with Granite Construction Company, in the amount of $219,243, plus a 10% contingency of $21,924.30, for a total amount of $241,167.30.

RECOMMENDATION
Adopt a Resolution awarding the bid and approving and authorizing the City Manager or designee to execute a Construction Contract and necessary documents for the American Avenue Improvements, CIP Project No. 336-31681, with Granite Construction Company, in the amount of $219,243, plus a 10% contingency of $21,924.30, for a total amount of $241,167.30.

PREVIOUS ACTION
On April 24, 2007, by Resolution No. 2007-87, City Council amended the 2006/07 – 2010/11 Capital Improvement Program (“CIP”) to include the American Avenue Improvements project and approved the contract documents and authorized staff to advertise the project, and also approved and authorized the City Manager or designee to execute a Reimbursement Agreement with the Brentwood Union School District (“BUSD”) for the Improvements.

BACKGROUND
The American Avenue Improvements project will widen approximately 1,300 feet of American Avenue to its ultimate width, including concrete curb and gutter. The location of the improvements is at the southeast end of American Avenue near Adams Middle School and will improve the flow of traffic in that area.

Staff advertised the project on April 3, 2007 and bids were opened on May 1, 2007. A total of six bids were received and are listed below:

Granite Construction Company $219,243.00
Top Grade Construction $244,310.00
Ghilotti Bros., Inc. $264,900.00
Bay Cities Paving and Grading $279,216.50
Ghilotti Company $286,141.00
Grade Tech, Inc. $378,790.00

After review of the bid proposals, staff recommends the award of the construction contract for the American Avenue Improvements, CIP Project No. 336-31681, to Granite Construction Company, for a contract amount of $219,243, plus a 10% contingency of $21,924.30, for a total amount of $241,167.30.

FISCAL IMPACT
The funds associated with this work are included in the adopted 2006/07 – 2010/11 Capital Improvement Program, which includes the American Avenue Improvements, CIP Project No. 336-31681.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AWARDING THE BID AND APPROVING AND AUTHORIZING THE CITY MANAGER OR DESIGNEE TO EXECUTE A CONSTRUCTION CONTRACT AND NECESSARY DOCUMENTS FOR THE AMERICAN AVENUE IMPROVEMENTS, CIP PROJECT NO. 336-31681, WITH GRANITE CONSTRUCTION COMPANY, IN THE AMOUNT OF $219,243, PLUS A 10% CONTINGENCY OF $21,924.30, FOR A TOTAL AMOUNT OF $241,167.30.

WHEREAS, on April 24, 2007, by Resolution No. 2007-87, City Council amended the 2006/07 – 2010/11 Capital Improvement Program (“CIP”) to include the American Avenue Improvements project and approved the contract documents and authorized staff to advertise the project, and also approved and authorized the City Manager or designee to execute a Reimbursement Agreement with the Brentwood Union School District (“BUSD”) for the Improvements; and

WHEREAS, staff advertised the project on April 3, 2007, and bids were opened on May 1, 2007, and a total of six bids were received with Granite Construction Company submitting the lowest, responsible, responsive bid.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby award the bid and approve and authorize the City Manager or designee to execute a Construction Contract and necessary documents for the American Avenue Improvements, CIP Project No. 336-31681, with Granite Construction Company, for a contract amount of $219,243, plus a 10% contingency, for a total amount of $241,167.30.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting held on the 22nd day of May 2007 by the following vote:
