Subject/Title: Adopt a Resolution approving and authorizing the City Manager or designee to execute Amendment No. Two to the Professional Services Agreement with Mark Thomas & Company, Inc. for the Brentwood Boulevard Widening - Central, CIP Project No. 336-31490, in the amount of $55,641, plus a 10% contingency of $5,564.10 for a total amount of $61,205.10.

RECOMMENDATION
Adopt a Resolution approving and authorizing the City Manager or designee to execute Amendment No. Two to the Professional Services Agreement with Mark Thomas & Company, Inc. for the Brentwood Boulevard Widening - Central, CIP Project No. 336-31490, in the amount of $55,641, plus a 10% contingency of $5,564.10 for a total amount of $61,205.10

PREVIOUS ACTION
On July 12, 2005, by Resolution No. 2005-173, City Council approved the Design Contract with Mark Thomas and Company, Inc. in the amount of $143,718, plus a 10% contingency of $14,371.80 for a total amount of $158,089.80, for the Brentwood Boulevard Widening – Central, CIP Project No. 336-31490.

On February 28, 2006, by Resolution No. 2006-34, City Council executed Amendment No. One to the Design Contract with Mark Thomas and Company, Inc. in the amount of $33,600, plus a 10% contingency of $3,360 for a total amount of $36,960, for the Brentwood Boulevard Widening – Central, CIP Project No. 336-31490.

BACKGROUND
The Brentwood Boulevard Widening - Central, CIP Project No. 336-3149, will continue the widening of Brentwood Boulevard between Village Drive and Central Boulevard. The project includes two lanes in each direction, with bike lane, curb and gutter, median, sidewalk, street lighting and landscaping. This project will improve traffic flow and provide a smooth progression along Brentwood Boulevard. This project is entirely within Caltrans jurisdiction and is required to go through their approval process.

The project has had some constraints, unforeseen and unanticipated obstacles to overcome during the submittal and plan check process for a Caltrans encroachment permit, resulting in Amendment No. One being added to the agreement in the amount of $33,600. That amendment included project redesign, temporary signal design and Storm Water Pollution Prevention Plan (SWPPP) preparation and was intended to take the project through approval and issuance of a Caltrans encroachment permit.

The project is currently out to bid, but still needs additional support services for construction and project closeout. The addition of Amendment No. Two to the Professional Services Agreement with Mark Thomas & Company, Inc. incorporates construction support services, construction staking, supplemental redesign and right-of-way mapping for Caltrans.

Staff is seeking City Council approval for $55,641, plus a 10% contingency of $5,564.10 for a total amount of $61,205.10, to complete the construction support services and project closeout.

FISCAL IMPACT
There are sufficient funds available in the approved 2006/07 -2010/11 Capital Improvement Program, which includes the Brentwood Boulevard Widening – Central, CIP Project No. 336-31490, to accommodate the additional $61,205.10.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the City Manager or designee is authorized to execute Amendment No. Two to the Professional Services Agreement in the amount of $55,641, plus a 10% contingency of $5,564.10 for a total amount of $61,205.10, with Mark Thomas & Company, Inc. for Brentwood Boulevard Widening - Central, CIP Project No. 336-31490.
