CITY COUNCIL AGENDA ITEM NO. 5

Subject/Title: Adopt a Resolution accepting the work performed by Bay Cities Paving & Grading Inc., for the 2005 Pavement Management Program, CIP Project No. 336-30830, and directing the City Clerk to file a Notice of Completion with the County Recorder.

RECOMMENDATION
Adopt a Resolution accepting the work performed by Bay Cities Paving & Grading Inc. for the 2005 Pavement Management Program, CIP Project No. 336-30830, and directing the City Clerk to file a Notice of Completion with the County Recorder.

PREVIOUS ACTION
On May 24, 2005, by Resolution No. 2005-115, City Council adopted the City’s 2005/06 – 2009/10 Capital Improvement Program that included the 2005 Pavement Management Program, CIP Project No. 336-30830.

On September 13, 2005, by Resolution No. 2005-218, City Council authorized the City Manager to award a contract for construction to Bay Cities Paving & Grading Inc. for the 2005 Pavement Management Program, CIP Project No. 336-30830 and execute change orders not to exceed 10% of the contract amount.

On October 11, 2005, adopted Resolution 2005-255 approving, and authorizing the City Manager to execute, a change order with Bay Cities Paving & Grading, Inc. for repair and resurfacing of the Brentwood Center parking lot in an amount not to exceed $392,477.55, and to authorize the City Manager to execute change order contingencies up to 10% in an amount not to exceed $39,247.76, for a total not to exceed $431,725.

BACKGROUND
The City conducts a survey of existing roads every three years and after analyzing the data and input from staff, determination is made which roads need immediate and urgent pavement repairs.

The 2005 Pavement Management Program consisted of the following work:

Reconstruction of Roadway

• Central Blvd. between Dainty Avenue and Minnesota Avenue.

Asphalt Overlays

• Windsor Way from Windsor pond to South end of street.
• Sweet Grass Drive from Balfour Road to Darby Drive.
• Darby Drive from Sweet Grass Drive to Essex Drive.
• Essex Drive from Darby Drive to Coventry Circle.

Cape Seals

• Nottingham Court - all
• Nebergall Court - all
• Sequoia Street from McClarren Road to Oak Street

Slurry Seals

A change order was added to the 2005 Pavement Management Program for the Brentwood Center. The work included replacement of 400 feet of sewer main line, removal and replacement of 39,596 square feet of damaged asphalt, in addition to concrete curb and sidewalk replacement, pass CR cape seal on 258,945 square feet of parking lot and all parking lot traffic and parking stall markings. There was a small portion of slurry seal that was not completed due to the inclement weather. The City received a credit for this portion of the work and will schedule a small overlay of slurry seal within the parking lot as part of the City’s annual slurry seal program when weather permits.

These improvements have been constructed in conformance with the approved plans and specifications, submittals and the approved changes in scope.

FISCAL IMPACT
The CIP funds budgeted for the 2005 Pavement Management Program; in fiscal year 2004/05 were utilized. The portion of the Brentwood Center work attributable to the tenants is being reimbursed by the tenants. The total contract amount for the work performed by Bay Cities Paving & Grading Inc. for the 2005 Pavement Management Project, CIP 336-39830 is as follows:

The work is complete and is below the City Council approved amount for these improvements. The City will release the final retention payment 35 days from the recordation date of the Notice of Completion.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE WORK PERFORMED BY BAY CITIES PAVING & GRADING INC., FOR THE 2005 PAVEMENT MANAGEMENT PROGRAM, CIP PROJECT NO. 336-30830 AND DIRECTING THE CITY CLERK TO FILE A NOTICE OF COMPLETION WITH THE COUNTY RECORDER.

WHEREAS, the final contract amount of $1,067,917.29 is below the Council-approved contract amount of $1,139,268.96, plus 10% contingency; and

WHEREAS, the work performed by Bay Cities Paving & Grading Inc. was completed and constructed in conformance with the approved plans and specifications.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brentwood that the work performed by Bay Cities Paving & Grading Inc. for the Pavement Management Program, CIP Project No. 336-30830, is hereby accepted.

BE IT FURTHER RESOLVED that the City Clerk is hereby directed to file a Notice of Completion with the County Recorder for this project.

NOTICE OF COMPLETION

NOTICE IS HEREBY GIVEN THAT:

THE CITY OF BRENTWOOD, a general law city, in the County of Contra Costa, State of California, did on the 13th day of September 2005 enter into an agreement with Bay Cities Paving & Grading Inc., for 2005 Pavement Management Program, CIP Project No. 336-30830.

The work described in the contract documents was to furnish all material, labor, and equipment necessary to complete pavement repair to various streets within the City of Brentwood..

On the 8th day of May 2007, said contract as a whole was completed and the work was accepted by the City Council of the City of Brentwood.

I hereby certify under penalty of perjury that the facts set forth in the foregoing Notice of Completion are true and correct.
