Subject/Title: Adopt a Resolution amending the 2006/07 – 2010/11 Capital Improvement Program to include the American Avenue Improvements project and approving the contract documents and authorizing staff to advertise the project, and also approving and authorizing the City Manager or designee to execute a Reimbursement Agreement with the Brentwood Union School District for the Improvements.

RECOMMENDATION
Adopt a Resolution amending the 2006/07 – 2010/11 Capital Improvement Program (“CIP”) to include the American Avenue Improvements project and approving the contract documents and authorizing staff to advertise the project, and also approving and authorizing the City Manager or designee to execute a Reimbursement Agreement with the Brentwood Union School District (“BUSD”) for the Improvements.

BACKGROUND
American Avenue is the main traffic route to and from the Heritage High School and Adams Middle School. The City in coordination with the school districts has already modified the intersection of American Avenue at Balfour Road to dual left turns on Balfour Road approaching American Avenue and dual right turn lanes on American Avenue approaching Balfour Road. These improvements have improved the overall traffic circulation as well as the continuous monitoring and adjustment to the traffic signal phasing and timing. As each of these schools increase their enrollment over the next couple of years, there will be an increased demand to enhance traffic circulation. Staff is requesting to add a CIP project to the current budget and fiscal year, which will widen the southerly 1,300 feet of American Avenue by approximately 12 feet on the east side of the roadway including the removal of two stop signs, storm drainage, curb and gutter and pavement marking modifications.

BUSD approved the reimbursement agreement for these improvements at their regularly scheduled Board Meeting on April 11, 2007. The reimbursement agreement outlines the roles and responsibilities of both the City and BUSD and outlines the cost sharing of these improvements. As proposed and discussed in the School Inter-Agency Committee meeting, the City will pay one third (1/3) of the total cost and BUSD will pay two thirds (2/3).

Staff is working aggressively to complete the American Avenue improvements prior to the beginning of the next school year (August 2007). In order to implement these improvements expeditiously staff requests that City Council amend the 2006/07 – 2010/11 CIP Budget to include this project, approve the reimbursement agreement with BUSD and approve the contract drawings.

FISCAL IMPACT
The attached CIP budget sheet reflects the proposed funding for the design, construction and administration of the American Avenue Improvements for FY 2006/07 and beyond. Funds for the City’s share in the amount of $118,112, for the widening of American Avenue improvements will be funded from Facility Fees.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AMENDING THE 2006/07 – 2010/11 CAPITAL IMPROVEMENT PROGRAM (“CIP”) TO INCLUDE THE AMERICAN AVENUE IMPROVEMENTS PROJECT AND APPROVING THE CONTRACT DOCUMENTS AND AUTHORIZING STAFF TO ADVERTISE THE PROJECT, AND ALSO APPROVING AND AUTHORIZING THE CITY MANAGER OR DESIGNEE TO EXECUTE A REIMBURSEMENT AGREEMENT WITH THE BRENTWOOD UNION SCHOOL DISTRICT (“BUSD”) FOR THE IMPROVEMENTS.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting on the 24th day of April 2007 by the following vote:
