RECOMMENDATION
Adopt a Resolution approving and authorizing the City Manager or designee to execute a Grant Deed and such other documents as may be needed to hereby convey real property on behalf of the City to the City for roadway purposes, identified as a portion of APN 019-050-025, generally located on the south side of Lone Tree Way at the intersection of Giannini Ranch Road (between Empire Avenue and Windy Springs Lane) for the Lone Tree Way Widening – Segments 1 & 2, CIP Project No. 336-31270.

PREVIOUS ACTION
On April 2, 2002, City Council adopted Resolution No. 2527, approving an agreement for purchase of a fee parcel with Bernice E. Lee, for real property identified as APN 019-050-025, generally located on the south side of Lone Tree Way between Empire Avenue and Windy Springs Lane for the Lone Tree Way Widening – Segments 1 & 2, CIP Project No. 336-31270.

On May 23, 2006, City Council adopted Resolution No. 2006-126, adopting the 2006/07 – 2010/11 Capital Improvement Program (“CIP”), that included the Lone Tree Way Widening – Segments 1 & 2, CIP Project No. 336-31270.

BACKGROUND
The purchase of the entire Lee property was necessary for the widening of Lone Tree Way from two lanes to six lanes and to construct various infrastructure improvements in the northwest quadrant, in order to support commercial and residential development in the area. The property was also necessary to construct an intersection that would provide safe ingress and egress to the La Paloma High School site adjacent to this property and for the commercial site on the north side of Lone Tree Way.

Currently the right-of-way for Lone Tree Way is comprised of many acquisitions from Heidorn Ranch Road to the railroad tracks just past Fairview Avenue. In an effort to simplify the City’s right-of-way for Lone Tree Way, the engineering firm for the project has prepared a Record of Survey Map. It has come to staff’s attention that in order to complete this map the City needs to designate a portion of the Lee parcel, owned by the City, as roadway. This map will save the City considerable time and effort should questions arise in the future regarding the City’s right-of-way for Lone Tree Way. It is customary that when the City acquires property that any portion that will be used for roadway purposes be so designated to allow it to become an official part of the City’s roadway system and separate the road from the remaining property that may be developed in the future.
Staff’s recommendation authorizing the execution of this Grant Deed should be considered a housekeeping issue.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING AND AUTHORIZING THE CITY MANAGER OR DESIGNEE TO EXECUTE A GRANT DEED AND SUCH OTHER DOCUMENTS AS MAY BE NEEDED TO HEREBY CONVEY REAL PROPERTY ON BEHALF OF THE CITY TO THE CITY FOR ROADWAY PURPOSES, IDENTIFIED AS A PORTION OF APN 019-050-025, GENERALLY LOCATED ON THE SOUTH SIDE OF LONE TREE WAY AT THE INTERSECTION OF GIANNINI RANCH ROAD (BETWEEN EMPIRE AVENUE AND WINDY SPRINGS LANE) FOR THE LONE TREE WAY WIDENING – SEGMENTS 1 & 2, CIP PROJECT NO. 336-31270.


WHEREAS, on April 2, 2002, City Council adopted Resolution No. 2527, approving an agreement for purchase of a fee parcel with Bernice E. WHEREAS, on May 23, 2006, City Council adopted Resolution No. 2006-126, adopting the 2006/07 – 2010/11 Capital Improvement Program (“CIP”), that included the Lone Tree Way Widening – Segments 1 & 2, CIP Project No. 336-31270; and

WHEREAS, the City owned property was purchased to provide right-of-way for roadway purposes; and

WHEREAS, a Grant Deed from the City of Brentwood to the City of Brentwood has been developed and is necessary for this portion of City property to become an official part of the City’s roadway system and separate the roadway from the remaining property that may be developed in the future.

NOW, THEREFORE BE IT RESOLVED, that the City Council of the City of Brentwood does hereby approve and authorize the City Manager or designee to execute a Grant Deed and such other documents as may be needed to hereby convey real property on behalf of the City to the City for roadway purposes, identified as a portion of APN 019-050-025, generally located on the south side of Lone Tree Way at the intersection of Giannini Ranch Road (between Empire Avenue and Windy Springs Lane) for the Lone Tree Way Widening – Segments 1 & 2, CIP Project No. 336-31270.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting held on the 24h day of April 2007 by the following vote:
