Subject/Title: Adopt a Resolution awarding the bid and approving and authorizing the City Manager or designee to execute a Construction Contract and necessary documents for the Non-Potable Water Distribution System – Phase I, CIP Project No. 592-59120 and the Water System Connections / Regulating, CIP Project No. 562-56280, with William G. McCullough Company, in the amount of $361,343, plus a 10% contingency of $36,134.30, for a total amount of $397,477.30.

RECOMMENDATION
Adopt a Resolution awarding the bid and approving and authorizing the City Manager or designee to execute a Construction Contract and necessary documents for the Non-Potable Water Distribution System – Phase I, CIP Project No. 592-59120 and the Water System Connections / Regulating, CIP Project No. 562-56280, with William G. McCullough Company, in the amount of $361,343, plus a 10% contingency of $36,134.30, for a total amount of $397,477.30.

PREVIOUS ACTION
On May 23, 2006, by Resolution No. 2006-126, City Council adopted the City’s 2006/07 – 2010/11 Capital Improvement Program (CIP), which included the Non-Potable Water Distribution System – Phase I, CIP Project No. 592-59120 and the Water System Connections / Regulating, CIP Project No. 562-56280.

BACKGROUND
The Grant Street Non-Potable Waterline Extension is located between Brentwood Boulevard and Cesar Chavez Drive. This project will tie into the existing non-potable water main on Sunset Road. This will provide non-potable water for the irrigation of 100 foot wide EBMUD right-of-way landscaping along Grant Street. In addition, we are connecting an 8-inch waterline on Gregory Lane to Brentwood Boulevard.

Staff advertised the Non-Potable Water Distribution System – Phase I (Grant Street Non-Potable Waterline Extension) project on March 6, 2007 and bids were opened on April 3, 2007. A total of seven bids were received and are listed below:

D.R. Lemings Construction Company, $363,303.00
D & D Pipelines, Inc., $391,948.00
California Trenchless, Inc. $398,098.00
Atlas Peak Construction $450,264.00
M.J.B. Pipeline, Inc. $469,333.00
ARB, Inc. $469,586.50

After review of the bid proposals, staff recommends the award of the construction contract for the Non-Potable Water Distribution System – Phase I, CIP Project No. 592-59120, and the Water System Connections / Regulating, CIP Project No. 562-56280, to William G. McCullough Company, for a contract amount of $361,343, plus a 10% contingency of $36,134.30, for a total amount of $397,477.30.

FISCAL IMPACT
The funds associated with this work are included in the adopted 2006/07 – 2010/11 Capital Improvement Program, which includes the Non-Potable Water Distribution System – Phase I, CIP Project No. 592-59120 and the Water System Connections / Regulating, CIP Project No. 562-56280. $352,000 will be paid from the Non-Potable Water Distribution System – Phase 1, CIP Project No. 592-59120 and $45,477.30 will be paid from the Water System Connections / Regulating, CIP Project No. 562-56280.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AWARDING THE BID AND APPROVING AND AUTHORIZING THE CITY MANAGER OR DESIGNEE TO EXECUTE A CONSTRUCTION CONTRACT AND NECESSARY DOCUMENTS FOR THE NON-POTABLE WATER DISTRIBUTION SYSTEM – PHASE I, CIP PROJECT NO. 592-59120, AND THE WATER SYSTEM CONNECTIONS / REGULATING, CIP PROJECT NO. 562-56280, WITH WILLIAM G. MCCULLOUGH COMPANY, IN THE AMOUNT OF $361,343, PLUS A 10% CONTINGENCY OF $36,134.30, FOR A TOTAL AMOUNT OF $397,477.30.


WHEREAS, on May 23, 2006, by Resolution No. 2006-126, City Council adopted the City’s 2006/07 – 2010/11 Capital Improvement Program (CIP), which included the Non-Potable Water Distribution System – Phase I, CIP Project No. 592-59120, and the Water System Connections / Regulating, CIP Project No. 562-56280; and

WHEREAS, staff advertised the project on March 6, 2007, and bids were opened on April 3, 2007, and a total of seven bids were received with William G. McCullough Company submitting the lowest, responsible, responsive bid.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby award the bid and approve and authorize the City Manager or designee to execute a Construction Contract and necessary documents with William G. McCullough Company, for a contract amount of $361,343, plus a 10% contingency, for a total amount of $397,477.30, for the Non-Potable Water Distribution System – Phase I, CIP Project No. 592-59120, in the amount of $352,000, and the Water System Connections / Regulating, CIP Project No. 562-56280 in the amount of $45,477.30.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting held on the 24th day of April 2007 by the following vote:
