Subject/Title: Adopt a Resolution accepting all offers of dedication for rights-of-way, easements, parcels of land and other rights as shown on the Final Map; accepting all public improvements, excluding the EBMUD trail and landscaping, for maintenance; accepting the Subdivision Maintenance Bond; and releasing the Subdivision Improvement Securities for Subdivision No. 8416, Sunset Crossing, located south of Sunset Road and east of Brentwood Boulevard, developed by DeNova Homes.

RECOMMENDATION
Adopt a Resolution accepting all offers of dedication for rights-of-way, easements, parcels of land and other rights as shown on the Final Map; accepting all public improvements, excluding the EBMUD trail and landscaping, for maintenance; accepting the Subdivision Maintenance Bond; and releasing the Subdivision Improvement Securities for Subdivision No. 8416, Sunset Crossing, located south of Sunset Road and east of Brentwood Boulevard, developed by DeNova Homes (“Developer”).

PREVIOUS ACTION
On November 8, 2000, by Resolution No. 00-75, Planning Commission approved Tentative Subdivision Map No. 8416, with conditions.

On October 8, 2002, by Resolution No. 2696, City Council approved Final Subdivision Map No. 8416, accepted the improvement securities and approved the Subdivision Improvement Agreement.

On January 21, 2003, Planning Commission amended Resolution No. 00-75, amending the Conditions of Approval for Tentative Subdivision Map No. 8416.

BACKGROUND
This subdivision, located south of Sunset Road and east of Brentwood Boulevard, contains 133 single-family residential lots. All improvements, excluding the EMBUD trail and landscaping, required by the Conditions of Approval for this subdivision have been constructed and inspected for conformance with the approved improvement plans including sewer, water and storm drain lines, sidewalk, paving, streetlights and fiber optics. The EMBUD trail and landscaping improvements are close to completion, and the Developer has posted separate Payment and Performance Bonds to guarantee this scope of work. As a part of this project, the Developer constructed the realignment of Sunset Road, over Marsh Creek, to the intersection of Brentwood Boulevard and Grant Street. Maintenance Bonds have been provided to cover the twelve-month warranty period for the public improvements that are complete.

As required by the Conditions of Approval and shown on the improvement plans, the Developer has installed the following improvement quantities: 4,400 linear feet (LF) of 8” sewer lines, 5,720 LF of 8” and 12” waterlines, 4,650 LF of various diameter storm drain lines, 12,300 LF of curb and gutter, 12,300 LF of 5’ sidewalk, 5,470 LF of pavement, 38 streetlights, 6,150 LF of joint trench including fiber optic conduit, 72,000 square feet (SF) of landscaping and irrigation and 800 LF of 10’ asphalt trail.

The necessary right-of-way offers of dedication and easements required for maintenance of the public improvements were offered to the City as a part of the final map upon acceptance of improvements. With the improvements now installed to support the new lots, it is the appropriate time to accept the improvements and dedications and begin the warranty period.

FISCAL IMPACT
Upon acceptance of improvements the City will incur annual costs associated with necessary maintenance of streets, landscaping and utilities. Routine roadway maintenance will be funded by the General Fund and Measure “C” transportation sales tax, with sewer and water maintenance funded through their respective enterprise funds. Landscaping and Lighting Assessment District (LLD) No. 01-1 has been formed for this subdivision and will be responsible for the street lighting and landscape maintenance in public areas.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING ALL OFFERS OF DEDICATION FOR RIGHTS-OF-WAY, EASEMENTS, PARCELS OF LAND AND OTHER RIGHTS AS SHOWN ON THE FINAL MAP; ACCEPTING ALL PUBLIC IMPROVEMENTS, EXCLUDING THE EBMUD TRAIL AND LANDSCAPING, FOR MAINTENANCE; ACCEPTING THE SUBDIVISION MAINTENANCE BOND; AND RELEASING THE SUBDIVISION IMPROVEMENT SECURITIES FOR SUBDIVISION NO. 8416, SUNSET CROSSING, LOCATED SOUTH OF SUNSET ROAD AND EAST OF BRENTWOOD BOULEVARD, DEVELOPED BY DENOVA HOMES.


WHEREAS, on November 8, 2000, by Resolution No. 00-75, Planning Commission approved Tentative Subdivision Map No. 8416, with conditions; and

WHEREAS, on October 8, 2002, by Resolution No. 2696, City Council approved Final Subdivision Map No. 8416, accepted the improvement securities and approved the Subdivision Improvement Agreement; and

WHEREAS, on January 21, 2003, Planning Commission amended Resolution No. 00-75, amending the Conditions of Approval for Tentative Subdivision Map No. 8416; and

WHEREAS, the required improvements, excluding the EBMUD trail and landscaping, have been completed and constructed in substantial conformance with the approved improvement plans; and

WHEREAS, DeNova Homes has posted Payment and Performance Bonds to guarantee completion of the EBMUD trail and landscape improvements; and

WHEREAS, right-of-way offers of dedication and easements required for public improvements were offered to the City upon the final map subject to acceptance of improvements.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood with respect to Subdivision No. 8416, Sunset Crossing, developed by DeNova Homes that:

1. All offers of dedication for rights-of-way, easements, parcels of land and other rights intended for public use as shown on the Final Map are hereby accepted.
2. All public improvements, excluding the EBMUD trail and landscaping, are hereby accepted for maintenance.
3. The Maintenance Bond to guarantee against defects in material and workmanship for a period of twelve months is hereby accepted.
4. The Subdivision Performance and Payment Bonds will be released within sixty (60) days of the passage of this Resolution.
5. The City Clerk is hereby directed to file this Resolution with the Recorder of Contra Costa County.
