Subject/Title: Adopt a Resolution awarding the bid and approving and authorizing the City Manager or designee to execute a Construction Contract and necessary documents for the Walnut Boulevard Widening – Phase II (Street), CIP Project No. 336-30560, to Top Grade Construction, Inc. in the amount of $1,794,794, plus a 10% contingency, for a total amount of $1,974,273.40.

RECOMMENDATION
Adopt a Resolution awarding the bid and approving and authorizing the City Manager or designee to execute a Construction Contract and necessary documents for the Walnut Boulevard Widening – Phase II (Street), CIP Project No. 336-30560, to Top Grade Construction, Inc. in the amount of $1,794,794, plus a 10% contingency, for a total amount of $1,974,273.40.

PREVIOUS ACTION
On May 26, 1998, City Council approved an updated Master Agreement, Administering Agency-State Agreement for Federal Aid Projects No. 04-5300.

On June 27, 2000, City Council authorized the City Manager to sign a design contract with Harris & Associates for the design of Walnut Boulevard Widening, CIP Project No. 336-30560, from Balfour Road to Oak Street.

On March 13, 2001, by Resolution No. 2249, City Council authorized the City Manager to execute a Program Supplement Agreement No. 002-M to Administering Agency-State Agreement No. 04-5300 for reimbursement of costs for preliminary engineering for the Walnut Boulevard Widening, CIP Project No. 336-30560.

On May 23, 2006, by Resolution No. 2006-126, City Council adopted the City’s 2006/07 – 2010/11 Capital Improvement Program that included the Walnut Boulevard Widening, CIP Project No. 336-30560.

On March 28, 2006, by Resolution No. 2006-52, City Council approved the Contract Documents and authorized the City Manager to execute a Construction Contract for the Walnut Boulevard Widening (Utilities), CIP Project No. 336-30560 to K. J. Woods Construction, Inc. in the amount of $1,984,000, plus a 10% contingency, for a total amount of $2,182,400.

BACKGROUND
Walnut Boulevard Widening (from Balfour Road to Oak Street) entails two phases of work. Phase I (Utilities) entails installation of storm drain, water, street lighting, fiber and signal interconnect conduit, and overhead power, phone and cable conversion to underground. Phase II (Street) entails widening the roadway to two lanes in each direction and installation of a median island and landscaping in the median island and in the parkway.

The City was awarded a grant in the amount of $1,300,000 from the Federal Intermodal Surface Transportation Efficiency Act (ISTEA) program, but due to time constraints it was impossible to meet Federal requirements. The Metropolitan Transportation Commission (MTC) approved the City’s request to transfer $1,110,000 of these funds to the Brentwood Boulevard Widening, CIP Project No. 336-30540, which was constructed in 2004. The City is obligated, per signed agreement with the State of California, to perform the Walnut Boulevard widening work, per Caltrans requirements. This obligation also includes, having Caltrans review and approve all the contract documents prior to advertising the project for bid. Also, the City was successful in obtaining another grant for up to $600,000, in reimbursement for Phase II roadway work; however, the City must award the contract by April 20, 2007, to be in compliance with the required deadlines of the grant.

As Phase I (Utilities) is nearing completion over the next six to eight weeks, staff will be preparing the necessary contracts, etc. to begin Phase II (Street) in early June. This will allow enough time in the schedule to complete Phase II, before the winter months and also during the school summer break.

Staff advertised Phase II of the project for construction beginning Friday, February 16, 2007 and bids were opened on March 21, 2007. A total of eight (8) bids were received, the bids were reviewed and the lowest responsive, responsible bid was received from Top Grade Construction, Inc.

The eight (8) bids were:

Staff recommends the award of the construction contract for the Walnut Boulevard Widening – Phase II (Street), CIP Project No. 336-30560 to Top Grade Construction, Inc., in the amount of $1,794,794, plus a 10% contingency of $179,479.40, for a total amount of $1,974,273.40.

FISCAL IMPACT
The funds associated with this work are included in the adopted 2006/07 – 2010/11 Capital Improvement Program, which includes the Walnut Boulevard Widening – Phase II (Street), CIP Project No. 336-30560.
