CONCERNING A CLOSED SESSION BEFORE THE
CITY COUNCIL OF THE CITY OF BRENTWOOD

TO: Honorable Mayor and City Council

FROM: Damien B. Brower, City Attorney

SUBJECT: Closed Session – Real Property [Gov’t. Code §54956.8]

Conference with Real Property Negotiators

Property: 385 Carroll Court, Brentwood

Negotiating Parties: Karen and Gary Kendall

City Negotiators: Howard Sword/Gina Rozenski

Under Negotiation: Price and terms of payment

A closed session will be held on March 27, 2007, for the purpose of giving instructions to your negotiator regarding the price and terms of payment for the purchase, sale, exchange or lease of real property. [Gov’t. Code §54956.8]

If the City Council renders an agreement final, they shall report that approval and the substance of the agreement in open session at the public meeting during which the closed session is held. [Gov’t Code §54957.1(a)(1)(A)]

If final approval rests with the other party to the negotiations, the City shall disclose the fact of that approval and the substance of the agreement upon inquiry by any person, as soon as the other party or its agent has informed the City of its approval. [Gov’t. Code §54957.1(i)(a)(1)(B)]
