Subject/Title: Adopt a Resolution awarding the bid and approving and authorizing the City Manager or designee to execute a Construction Contract and necessary documents for Well #15, CIP Project No. 562-56310, to Manito Construction, Inc., in the amount of $613,900, plus a 5% contingency of $30,695, for a total amount of $644,595.

RECOMMENDATION
Adopt a Resolution awarding the bid and approving and authorizing the City Manager or designee to execute a Construction Contract and necessary documents for Well #15, CIP Project No. 562-56310, to Manito Construction, Inc., in the amount of $613,900, plus a 10% contingency of $30,695 for a total amount of $644,595.

PREVIOUS ACTION
On August 23, 2005, by Resolution No. 2005-202, City Council authorized the City Manager to execute a Professional Services Agreement with Kimley-Horn and Associates, Inc. to provide design services in the amount of $118,198.05, plus contingency for the site design of Well #15, CIP Project No. 562-56310.

On May 23, 2006, by Resolution No. 2006-115, City Council adopted the City’s 2006/07 – 2010/11 Capital Improvement Program (CIP), which included Well #15, CIP Project No. 562-56310.

On February 13, 2007, by Resolution No. 2007-20, City Council rejected the bids received for Well #15, CIP Project No. 562-56310 and directed staff to readvertise, rebid the project and return to City Council for award of the contract.

BACKGROUND
Well #15 is located across from the City of Brentwood’s Corporation Yard on Elkins Way. The well itself has been drilled and established, along with the pump, motor and associated piping. This well site improvement project includes a new control system, chemical systems, permanent power and permanent fencing.

Staff advertised the Well #15 project on December 18, 2006, and held the bid opening on January 23, 2007, at 2:00 p.m. A total of five bids were received and all bids exceeded the project budget for construction. Specifically, there were three bid items that far exceeded the Engineer’s estimate (sewerline, prefabricated fiberglass buildings and programming), which precluded staff from recommending the award of this contract. On February 13, 2007, City Council rejected all bids and authorized staff to readvertise the project. Staff reviewed the existing scope of the project to determine if it could be modified to reduce the overall construction cost.

Staff readvertised the project on February 16, 2007, and bids were opened on March 15, 2007. A total of four bids were received and the apparent low bid is $79,213 less than the previous bids that were rejected. The bids amounts are as follows:

Manito Construction, Inc., $613,900
Albay Construction Company $622,900
TNT Industrial Contractors, Inc. $647,100
McGuire and Hester $665,450

After review of the bid proposals, staff recommends the award of the construction contract for Well #15, CIP Project No. 562-56310 to Manito Construction, Inc. for a total contract amount of $613,900, plus a 5% contingency of $30,695, for a total amount of $644,595.

FISCAL IMPACT
The funds associated with this work are included in the adopted 2006/07 – 2010/11 Capital Improvement Program, which includes approximately $645,000 for the construction phase of the Well #15, CIP Project No. 562-56310.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AWARDING THE BID AND APPROVING AND AUTHORIZING THE CITY MANAGER OR DESIGNEE TO EXECUTE A CONSTRUCTION CONTRACT AND NECESSARY DOCUMENTS FOR WELL #15, CIP PROJECT NO. 562-56310, TO MANITO CONSTRUCTION, INC., IN THE AMOUNT OF $613,900, PLUS A 5% CONTINGENCY OF $30,695, FOR A TOTAL AMOUNT OF $644,595.

WHEREAS, a total of four bids were received, with Manito Construction submitting the lowest, responsible, responsive bid; and

WHEREAS, staff is recommending the award of contract to Manito Construction.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby award the bid and approve and authorize the City Manager or designee to execute a Construction Contract and necessary documents for Well #15, CIP Project No. 562-56310, to Manito Construction, Inc., in the amount of $613,900, plus a 5% contingency of $30,695, for a total amount of $644,595.
