Adopt a Resolution accepting all public improvements for maintenance;
accepting the Subdivision Maintenance Bond; and releasing the Subdivision
Improvement Securities for Subdivision No. 8561, Rose Garden Phase I,
located north of Lone Tree Way and south of Neroly Road, developed by Pulte
On September 23, 2003, by Resolution No. 03-72, Planning Commission approved
Tentative Subdivision Map No. 8561, with conditions.
On June 22, 2004, City Council was notified through an Informational Report
of the City Manager’s approval of Final Subdivision Map No. 8561, acceptance
of improvement securities and approval of the Subdivision Improvement
This subdivision, located north of Lone Tree Way and south of Neroly Road,
contains 281 single-family residential lots. All improvements required by
the Conditions of Approval for this subdivision have been constructed and
inspected for conformance with the approved improvement plans including
sewer, water and storm drain lines, sidewalk, paving, streetlights and fiber
optics. As a part of this project, Pulte Homes has widened Lone Tree Way and
Neroly Road and constructed 8 acres of parks and a trail along the west and
north boundaries of the project. Pulte Homes has provided Maintenance Bonds
to cover the twelve-month warranty period for all public improvements.
As required by the Conditions of Approval and shown on the improvement
plans, the Developer has installed the following improvement quantities:
11,750 linear feet (LF) of 8” sewer lines, 5,350 LF of 12” sewer lines,
25,835 LF of various diameter waterlines, 19,350 LF of 18” to 60” storm
drain lines, 39,025 LF of curb and gutter, 39,133 LF of sidewalk, 18,588 LF
of pavement, 140 streetlights, 20,236 LF of joint trench including fiber
optic conduit, 428,165 square feet (SF) of landscaping and irrigation and
1,880 LF of 12’ asphalt trail.
The necessary right-of-way offers of dedication and easements required for
maintenance of the public improvements were offered to the City and accepted
as a part of the final map. With the improvements now installed to support
the new lots, it is the appropriate time to accept the improvements and
begin the warranty period.
Upon acceptance of improvements the City will incur annual costs associated
with necessary maintenance of streets, landscaping and utilities. Routine
roadway maintenance will be funded by the General Fund and Measure “C”
transportation sales tax, with sewer and water maintenance funded through
their respective enterprise funds. Landscaping and Lighting Assessment
District (LLD) No. 03-2 has been formed for this subdivision and will be
responsible for the street lighting and landscape maintenance in public

PUBLIC IMPROVEMENTS FOR MAINTENANCE; ACCEPTING THE SUBDIVISION MAINTENANCE
BOND; AND RELEASING THE SUBDIVISION IMPROVEMENT SECURITIES FOR SUBDIVISION
NO. 8561, ROSE GARDEN PHASE I, LOCATED NORTH OF LONE TREE WAY AND SOUTH OF
NEROLY ROAD, DEVELOPED BY PULTE HOMES (“DEVELOPER”).
WHEREAS, on September 23, 2003, by Resolution No. 03-72, Planning Commission
approved Tentative Subdivision Map No. 8561, with conditions; and
WHEREAS, on June 22, 2004, City Council was notified through an
Informational Report of the City Manager’s approval of Final Subdivision Map
No. 8561, acceptance of improvement securities and approval of the
Subdivision Improvement Agreement; and
WHEREAS, the required improvements, have been completed and constructed in
substantial conformance with the approved improvement plans; and
WHEREAS, right-of-way offers of dedication and easements required for public
improvements were offered upon the final map and accepted by the City at
final map approval.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood
with respect to Subdivision No. 8561, Pulte Homes, that:
1. All public improvements for maintenance are hereby accepted.
2. The Maintenance Bond to guarantee against defects in material and
workmanship for a period of twelve months is hereby accepted.
3. The Subdivision Performance and Payment Bonds will be released within
sixty (60) days of the passage of this Resolution.
4. The City Clerk is hereby directed to file this Resolution with the
Recorder of Contra Costa County.
