Meeting Date: March 27, 2007

Subject/Title: Set the date of April 10, 2007, to hear an appeal filed by Bailey Neff of Minnesota Rentals, Inc., of the Planning Commission’s decision approving an application for a tentative subdivision map (TSM 8446). The property is located at 1060 Minnesota Avenue (APN 017-080-007).

RECOMMENDATION
Set April 10, 2007, as the hearing date to consider the appeal by Bailey Neff of Minnesota Rentals, Inc., in regard to the Planning Commission’s decision approving an application for a tentative subdivision map (TSM 8446).

PREVIOUS ACTIONS
• City Council approval of a Residential Growth Management Allocation (RGMP 05-A2) for an 8-lot development on February 28, 2006, by Resolution No. 2006-40.

• Planning Commission approval of a rezone (RZ 06-02) establishing development standards for the property on June 6, 2006, by Resolution No. 06-26 with subsequent adoption by City Council on June 27, 2006, by Ordinance No. 830.

• Planning Commission denial of an appeal by Bailey Neff, Minnesota Rentals, Inc., of the Community Development Department’s determination regarding the completeness of an application for a proposed tentative subdivision map (TSM 8446) on October 3, 2006, by Resolution No. 06-105.

• City Council denial of an appeal by Bailey Neff, Minnesota Rentals, Inc., of the Planning Commission’s determination regarding the completeness of an application for the proposed TSM 8446 on October 24, 2006, by Resolution No. 2006-273.

• Planning Commission approval of a Mitigated Negative Declaration for the project and approval of TSM 8446 on March 6, 2007, by Resolution Nos. 07-022 and 07-023, respectively.

BACKGROUND
At a public hearing before the Planning Commission on March 6, 2007, the Planning Commission voted 5-0 to approve both the mitigated negative declaration prepared for the project and the application for tentative subdivision map (TSM 8446). Bailey Neff of Minnesota Rentals, Inc., has filed an appeal of this approval primarily objecting to several conditions of approval which were placed on the project, as well as purported delays by City staff in the processing of the project and processing fees.

As required by Section 17.880.003.C, Bailey Neff has completed the required application, submitted the required appeal fee, and provided a statement setting forth the specific grounds for the appeal. It is a procedural requirement that the City Council set the hearing. It is recommended that the City Council set April 10, 2007, as the date for the hearing on the appeal request.

FISCAL IMPACT
The applicant paid the required $118 appeal fee.
