RECOMMENDATION
Adopt a Resolution accepting all offers of dedication for rights-of-way, easements, parcels of land and other rights as shown on the Final Maps; accepting all public improvements for maintenance; accepting the Subdivision Maintenance Bonds; and releasing the Subdivision Improvement Securities for Deer Ridge Subdivision Nos. 7690, 8310-Phase I and 8484, located south of Balfour Road and west of John Muir Parkway, developed by California Sun-Brentwood, LLC.

PREVIOUS ACTION
On January 19, 1993, by Resolution No. 93-2, Planning Commission approved Tentative Subdivision Map No. 7690, with conditions.

On January 12, 1999, by Resolution No. 99-18, City Council approved Final Subdivision Map No. 7690, accepting the improvement securities and approving the Subdivision Improvement Agreement.

On October 10, 2000, by Resolution No. 2169, City Council approved Final Subdivision Map No. 8310, accepting the improvement securities and approving the Subdivision Improvement Agreement.

On March 26, 2002, by Resolution No. 2493, City Council approved Final Subdivision Map No. 8484, accepting the improvement securities and approving the Subdivision Improvement Agreement.

BACKGROUND
Tentative Subdivision Map approval for this project, located south of Balfour Road and west of John Muir Parkway, included the approval for a maximum of 1,031 residential lots and an 18-hole golf course. California Sun-Brentwood, LLC (“Developer”) constructed the required off-site public improvements and master “backbone” infrastructure to support villages, or groups of lots, that were then further subdivided and developed by other companies. The off-site and Phase I backbone improvements required by the Conditions of Approval for this project have been constructed and inspected for conformance with the approved improvement plans, including sewer, water and storm drain lines, sidewalk, paving, streetlights and fiber optics. As a part of this project, the Developer constructed Balfour Road widening, from Mt. View Drive east to John Muir Parkway, John Muir Parkway from Balfour Road south to Eagle Rock Avenue, Eagle Rock Avenue, as an additional easterly access to the project, traffic signals at the intersections of Balfour Road, Foothill Drive and John Muir Parkway and the 10-acre Oak Meadow Park. The Developer has provided Maintenance Bonds to cover the twelve-month warranty period for all improvements in the subdivision that have been completed.

As required by the Conditions of Approval and shown on the improvement plans, the Developer has installed the following improvement quantities: 18,165 linear feet (LF) of 8”-15” sewer lines, 17,374 LF of 6”-16” water lines, 835 LF of 12” non-potable water line, 457,655 LF of various diameter storm drain lines, 34,347 LF of curb and gutter, 33,303 LF of 5’ sidewalk, 22,477 LF of pavement, 104 streetlights, 2 traffic signals, 27,197 LF of joint trench including fiber optic conduit and a 10-acre park.

When the Final Maps were approved by the City Council, the right-of-way offers of dedication were accepted subject to acceptance of improvements. The improvements are now installed to support the new villages and lots; therefore, it is the appropriate time to accept the improvements, rights-of-way and easements as offered on the Final Maps.

FISCAL IMPACT
Upon acceptance of improvements, the City will incur annual costs associated with necessary maintenance of streets, landscaping and utilities. Routine roadway maintenance will be funded by the General Fund and Measure “C” transportation sales tax, with sewer and water maintenance funded through their respective enterprise funds. Landscaping and Lighting Assessment District (LLD) No. 99-5 has been formed for this subdivision and will be responsible for the street lighting and landscape maintenance.

ADOPT A RESOLUTION ACCEPTING ALL OFFERS OF DEDICATION FOR RIGHTS-OF-WAY, EASEMENTS, PARCELS OF LAND AND OTHER RIGHTS AS SHOWN ON THE FINAL MAPS; ACCEPTING ALL PUBLIC IMPROVEMENTS FOR MAINTENANCE; ACCEPTING THE SUBDIVISION MAINTENANCE BONDS; AND RELEASING THE SUBDIVISION IMPROVEMENT SECURITIES FOR DEER RIDGE SUBDIVISION NOS. 7690, 8310-PHASE I AND 8484, LOCATED SOUTH OF BALFOUR ROAD AND WEST OF JOHN MUIR PARKWAY, DEVELOPED BY CALIFORNIA SUN-BRENTWOOD, LLC.

WHEREAS, on January 19, 1993, Resolution No. 93-2, Planning Commission approved Tentative Subdivision Map No. 7690, with conditions; and

WHEREAS, on January 12, 1999, by Resolution No. 99-18, City Council approved Final Subdivision Map No. 7690, accepting the improvement securities and approving the Subdivision Improvement Agreement; and

WHEREAS on October 10, 2000, by Resolution No. 2169, City Council approved Final Subdivision Map No. 8310, accepting the improvement securities and approving the Subdivision Improvement Agreement; and

WHEREAS on March 26, 2002, by Resolution No. 2493, City Council approved Final Subdivision Map No. 8484, accepting the improvement securities and approving the Subdivision Improvement Agreement; and

WHEREAS, the required public improvements, have been completed and constructed in substantial conformance with the approved improvement plans; and

WHEREAS, California Sun-Brentwood, LLC has posted Maintenance Bonds, guaranteeing materials and workmanship, for a period of one year following acceptance of improvements.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood with respect to Subdivision Nos. 7690, 8310-Phase I and 8484, Deer Ridge, developed by California Sun-Brentwood, LLC, that:

1. All public improvements for maintenance are hereby accepted.
2. All offers of dedication for rights-of-way, easements, parcels of land and other rights intended for public use as shown on the Final Map are hereby accepted.
3. The Maintenance Bond to guarantee against defects in material and workmanship for a period of twelve months is hereby accepted.
4. The Subdivision Performance and Payment Bonds will be released within sixty (60) days of the passage of this Resolution.
5. The City Clerk is hereby directed to file this Resolution with the Recorder of Contra Costa County.
