RECOMMENDATION
Adopt a Resolution approving the speed limits for sections of Fairview Avenue, O’Hara Avenue and Grant Street, within the City of Brentwood.

PREVIOUS ACTION
On May 23, 2006, by Resolution No. 2006-115, City Council adopted the City’s 2006/07 – 2010/11 Capital Improvement Program (CIP), which included the Roadway Signing and Striping, CIP Project No. 336-31470.

BACKGROUND
The California Vehicle Code Sections 627, 22348 through 22413, and 40802 require local agencies to perform engineering and traffic surveys in order for the Police Department to enforce the speed limit by the use of radar.

Whenever the local agency builds new roadways or modifies an existing roadway, the agency may, by resolution, determine and declare the speed limit found most appropriate with an engineering speed survey. To provide proper circulation and improve safety for the public, staff performed engineering and traffic surveys for sections of Fairview Avenue, O’Hara Avenue and Grant Street, within the City of Brentwood.

After review of the surveys, the Traffic Engineer recommends a speed limit of 35 miles per hour for Fairview Avenue between Baldwin Drive and Concord Avenue, Grant Street between Fairview Avenue and Shady Willow Lane, and O’Hara Avenue between Sand Creek Road and Grant Street. The City Engineer has reviewed and accepted these recommendations.

FISCAL IMPACT
The speed limit currently posted on Fairview Avenue and Grant Street matches the recommended speed limits; therefore, no cost will be incurred. The speed limit currently posted on O’Hara Avenue is 30 miles per hour; therefore, the existing signs will need to be replaced. The cost for this work is estimated to be less than $1,000 and will be paid through the Roadway Signing and Striping, CIP Project No. 336-31470, included in the existing budget as approved in the 2006/07 – 2010/11 Capital Improvement Program.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING THE SPEED LIMITS FOR SECTIONS OF FAIRVIEW AVENUE, O’HARA AVENUE AND GRANT STREET, WITHIN THE CITY OF BRENTWOOD.

WHEREAS, Sections 627, 22348 through 22413, and 40802 of the California Vehicle Code, provides the mechanism for local authorities to “determine and declare” a prima facie speed limit on the basis of an engineering and traffic survey; and

WHEREAS, Title 10, Chapter 10.03, of the Brentwood Municipal Code describes a procedure for the establishment of such regulations; and

WHEREAS, engineering and traffic surveys were prepared and analyzed.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby approve and declare that the prima facie speed limit determined by the engineering and traffic survey and recommended by the Traffic Engineer is as follows:
