Adopt a Resolution approving and authorizing the City Manager to execute an
amendment to a Professional Services Agreement with Contra Costa County
Officials increasing the agreement amount from $33,000 to $60,000 and
changing the time of payment.
In August 2006 an agreement was executed with Contra Costa County Officials
for the 2006/07 fiscal year in the amount of $33,000. Youth and adult sports
leagues and programs have grown tremendously during the first six months of
fiscal year 2006/07. With the addition of Sunset Park Athletic Complex the
Parks and Recreation Department has been able to meet community demand for
services. The popularity and success of adult and youth sports has increased
the need for additional divisions of play, leagues and numbers of total
games. The growth of youth and adult sports has increased the cost of
officiating these leagues. In addition, the request has been made by the
referee/umpire assignor to change the net 30 days for payment to net 10 as
the officials are paid on a bi weekly basis.
Many youth and adult sport programs will take place over the next five
months. Five percent (5%) growth is forecast for all youth and adult sport
programs. The following is a breakdown of the programs and leagues that will
take place over the next five months resulting in additional expense with
Contra Costa Officials. The following sports will take place for the
remainder of the fiscal year:
• Girls USSSA Youth Softball
• Men’s Flag Football
• Men’s 30 and over basketball
• Men’s Spring Softball
• Men’s Summer Softball
Based on the 2006/07 expenses, all of the programs and leagues listed will
have a total estimated additional cost of $27,000 for officiating services.
The breakdown is as follows:
February – June 2007 Officiating Expenses
The $27,000 of additional expenses will be covered by the existing 2006/07
general fund operating budget.
Agreement for Professional Services
Amendment No. 1 To Amend Agreement
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING AND
AUTHORIZING THE CITY MANAGER TO EXECUTE AN AMENDMENT TO THE PROFESSIONAL
SERVICES AGREEMENT WITH CONTRA COSTA COUNTY OFFICIALS INCREASING THE
AGREEMENT AMOUNT FROM $33,000 TO $60,000 AND CHANGING THE TIME OF PAYMENT.
WHEREAS, in August 2006, the City of Brentwood entered into a professional
services agreement with Contra Costa County Officials for officiating
services (the “Agreement”); and
WHEREAS, Contra Costa County Officials has performed to the satisfaction of
the City under the Agreement; and
WHEREAS, it is necessary to increase the Agreement amount from $33,000 to
$60,000 to accommodate the next five months of youth and adult sport
WHEREAS, the City of Brentwood has participant registration fees to offset
the cost of officials for youth and adult sports
NOW, THEREFORE BE IT RESOLVED, that the City Council of the City of
Brentwood hereby approve and authorize the City Manager to execute an
amendment to the Agreement to increase the Agreement amount from $33,000 to
$60,000 and to change the time of payment.

a regular meeting held on the 13th day of March 2007, by the following vote:
AMENDMENT NO. 1
TO THE AGREEMENT FOR
CONTRA COSTA COUNTY OFFICIALS
This Amendment No. 1 is entered into and effective as of the ____ day of
March, 2007, amending the agreement dated August 16, 2006 (the “Agreement”)
by and between the City of Brentwood a municipal corporation of the State of
California ("City"), and Contra Costa County Officials (“Consultant")
(collectively, the “Parties”) for officiating service.

officiating services on an as needed basis not to exceed a total agreement
NOW, THEREFORE, in consideration of these recitals and the mutual covenants
contained herein, the Parties agree as follows:
1. Section 5 A - Payment of Consultant of the Agreement is amended to
increase the Agreement amount by Twenty Seven Thousand Dollars ($27,000) for
a total not to exceed Agreement amount of Sixty Thousand Dollars
2. Section 5 C of the agreement is amended in its entirety to read as
follows: “Within ten (10) days after receipt of each application for
progress payment, City shall verify the accuracy of the progress payment
application, correct the charges where appropriate, and make payment to
Consultant in an amount equal to the amount of such application, as verified
or corrected by City. City reserves the right to withhold payment from
Consultant on account of Services not performed satisfactorily, delays in
Consultant's performance of Services, or other defaults hereunder.
Consultant shall not stop or delay performance of Services under this
Agreement on account of payment disputes with City”.
3. All other provisions of the Agreement, as may have been amended from time
to time, will remain in full force and effect.
4. All requisite insurance policies to be maintained by the Consultant
pursuant to the Agreement, as may have been amended from time to time, will
include coverage for this Amendment.
5. The individuals executing this Amendment on behalf of Consultant each
represent and warrant that they have the legal power, right and actual
authority to bind Consultant to the terms and conditions of this Amendment.
