CITY COUNCIL AGENDA ITEM NO. 6

Meeting Date: March 13, 2007

Subject/Title: Adopt a Resolution accepting the work performed by Granite Construction Company for the 2006 Pavement Management Program, CIP Project No. 336-30830, and directing the City Clerk to file a Notice of Completion with the County Recorder.

RECOMMENDATION
Adopt a Resolution accepting the work performed by Granite Construction Company for the 2006 Pavement Management Program, CIP Project No. 336-30830, and directing the City Clerk to file a Notice of Completion with the County Recorder.

PREVIOUS ACTION
On May 23, 2006, by Resolution No. 2006-126, City Council adopted the City’s 2006/07 – 2010/11 Capital Improvement Program that included the 2006 Pavement Management Program, CIP Project No. 336-30830.

On August 22, 2006, by Resolution No. 2006-193, City Council authorized the City Manager to award a contract for construction to Granite Construction Company for the 2006 Pavement Management Program, CIP Project No. 336-30830, and execute change orders not to exceed 10% of the contract amount.

BACKGROUND
The City conducts a survey of existing roads every three years and after analyzing the data and input from staff, determination is made as to which roads need immediate and urgent pavement repairs.

The 2006 Pavement Management Program consisted of the following work:
Asphalt Rubber Overlays
• Walnut Blvd. between Balfour Road and the southern City limit
• Balfour Road between Brentwood Blvd. and 200 feet east of Hickory Drive
Asphalt Overlays
• Minnesota Avenue from Balfour Road to Deer Creek Channel
• Central Blvd. from Brentwood Blvd. to Southern Pacific Railroad (SPRR) tracks
• Second Street from Brentwood Blvd. to Central Avenue
• O’Hara Avenue from Central Blvd. to Second Street
• Dainty Avenue from Walnut Blvd. to 930 Dainty Avenue

These improvements have been constructed in conformance with the City-approved plans and specifications, submittals and approved changes in scope.

FISCAL IMPACT
The final contract amount for Granite Construction Company is $2,481,145.89, which is below the Council-approved contract amount of $2,554,088 plus 10% contingency. The cost of this contract was included in CIP Project No. 336-30830 of the approved 2006/07 – 2010/11 Capital Improvement Program Budget. The total project budget is $2,998,174.

The City will release the final retention payment 35 days from the recordation date of the Notice of Completion.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE WORK PERFORMED BY GRANITE CONSTRUCTION COMPANY, FOR THE 2006 PAVEMENT MANAGEMENT PROGRAM, CIP PROJECT NO. 336-30830, AND DIRECTING THE CITY CLERK TO FILE A NOTICE OF COMPLETION WITH THE COUNTY RECORDER.

WHEREAS, on May 23, 2006, by Resolution No. 2006-126, City Council adopted the City’s 2006/07 – 2010/11 Capital Improvement Program that included the 2006 Pavement Management Program, CIP Project No. 336-30830; and

WHEREAS, on August 22, 2006, by Resolution No. 2006-193, City Council authorized the City Manager to award a contract for construction to Granite Construction Company for the 2006 Pavement Management Program, CIP Project No. 336-30830, and execute change orders not to exceed 10% of the contract amount; and

WHEREAS, the work performed by Granite Construction Company was completed and constructed in conformance with the City-approved plans and specifications; and

WHEREAS, the final contract amount of $2,481,145.89 is below the Council-approved contract amount of $2,554,088, plus 10% contingency, and is $517,028.11 below the total project budget.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brentwood that the work performed by Granite Construction Company for the Pavement Management Program, CIP Project No. 336-30830, is hereby accepted.

BE IT FURTHER RESOLVED that the City Clerk is hereby directed to file a Notice of Completion with the County Recorder for this project.

NOTICE OF COMPLETION

NOTICE IS HEREBY GIVEN THAT:

THE CITY OF BRENTWOOD, a general law city, in the County of Contra Costa, State of California, did on the 22nd day of August 2006 enter into an agreement with Granite Construction Company, for the 2006 Pavement Management Program, CIP Project No. 336-30830.

The work described in the contract documents was to furnish all material, labor, and equipment necessary to complete said project.

On the 13th day of March 2007, said contract as a whole was completed and the work was accepted by the City Council of the City of Brentwood.

I hereby certify under penalty of perjury that the facts set forth in the foregoing Notice of Completion are true and correct.
