RECOMMENDATION
Adopt a Resolution accepting all public improvements for maintenance; accepting the Subdivision Maintenance Bond; and releasing the Subdivision Improvement Securities for Subdivision No. 8574, Sycamore Square, located south of Sycamore Avenue and north of Spruce Street, developed by Richmond American Homes (“Developer”).

PREVIOUS ACTION
On October 29, 2002, by Resolution No. 02-63, Planning Commission approved Tentative Subdivision Map No. 8574, with conditions.

On March 23, 2004, City Council was notified through an Informational Report of the City Manager’s approval of Final Subdivision Map No. 8574, acceptance of improvement securities and approval of the Subdivision Improvement Agreement.

On May 25, 2004, by Resolution No. 2004-120, City Council approved a Reimbursement Agreement with Richmond American Homes for Master Planned Improvements constructed as a part of Subdivision No. 8574.

BACKGROUND
This subdivision, located south of Sycamore Avenue and north of Spruce Street, contains 53 single-family residential lots. All improvements required by the Conditions of Approval for this subdivision have been constructed and inspected for conformance with the approved improvement plans including sewer, water and storm drain lines, sidewalk, paving, streetlights and fiber optics. All utilities installed as a part of this project will be publicly maintained, including off-site streets and sidewalks. The interior streets, sidewalks and landscaping will be privately maintained by the Homeowners Association. In conjunction with this project, the Developer extended Spruce Street, from its easterly terminus at Liberty High School, past the athletic fields to connect to Shasta Daisy Drive. This helped to improve traffic at the north end of the High School and, by increasing traffic circulation and adding streetlights, also decreased loitering and vandalism that was once a problem on this dead end street. The Developer has provided a Maintenance Bond to cover the twelve-month warranty period for all public improvements.

As required by the Conditions of Approval and shown on the improvement plans, the Developer has installed the following improvement quantities: 1,156 linear feet (LF) of 8” sewer lines, 3,616 LF of 8” waterlines, 4,292 LF of 18”- 42” storm drain lines, 4,480 LF of curb and gutter, 3,260 LF of 5’ sidewalk, 2,623 LF of pavement, 18 streetlights and 1,292 LF of joint trench including fiber optic conduit.

The necessary right-of-way offers of dedication and easements required for maintenance of the public improvements were offered to the City and accepted as a part of the final map. With the improvements now installed to support the new lots, it is the appropriate time to accept the improvements and begin the warranty period.

FISCAL IMPACT
Upon acceptance of improvements, the City will incur annual costs associated with necessary maintenance of utilities and off-site pavement only. Routine roadway maintenance will be funded by the General Fund and Measure “C” transportation sales tax, with sewer and water maintenance funded through their respective enterprise funds. Landscaping and Lighting Assessment District (LLD) No. 02-2 has been formed for this subdivision and will be responsible for the street lighting and landscaping maintenance in public areas.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING ALL PUBLIC IMPROVEMENTS FOR MAINTENANCE; ACCEPTING THE SUBDIVISION MAINTENANCE BOND; AND RELEASING THE SUBDIVISION IMPROVEMENT SECURITIES FOR SUBDIVISION NO. 8574, SYCAMORE SQUARE, LOCATED SOUTH OF SYCAMORE AVENUE AND NORTH OF SPRUCE STREET, DEVELOPED BY RICHMOND AMERICAN HOMES.

WHEREAS, on October 29, 2002, by Resolution No. 02-63, Planning Commission approved Tentative Subdivision Map No. 8574, with conditions; and

WHEREAS, on March 23, 2004, City Council was notified through an Informational Report of the City Manager’s approval of Final Subdivision Map No. 8574, acceptance of improvement securities and approval of the Subdivision Improvement Agreement; and

WHEREAS, on May 25, 2004, by Resolution No. 2004-120, City Council approved a Reimbursement Agreement with Richmond American Homes for Master Planned Improvements constructed as a part of Subdivision No. 8574; and

WHEREAS, the required improvements, have been completed and constructed in substantial conformance with the approved improvement plans; and

WHEREAS, right-of-way offers of dedication and easements required for public improvements were offered upon the final map and accepted by the City at final map approval.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood with respect to Subdivision No. 8574, Sycamore Square, developed by Richmond American Homes that:
1. All public improvements for maintenance are hereby accepted.
2. The Maintenance Bond to guarantee against defects in material and workmanship for a period of twelve months is hereby accepted.
3. The Subdivision Performance and Payment Bonds will be released within sixty (60) days of the passage of this Resolution.
4. The City Clerk is hereby directed to file this Resolution with the Recorder of Contra Costa County.
