Subject/Title: Adopt a Resolution approving and authorizing the City Manager or designee to execute a Grant of Easement with East Bay Municipal Utility District (EBMUD) for the extension of Adams Lane, generally located between Lone Tree Way and Grant Street, east of O’Hara Avenue.

RECOMMENDATION
Adopt a Resolution approving and authorizing the City Manager or designee to execute a Grant of Easement with East Bay Municipal Utility District (EBMUD), and such other documents as may be needed to complete the transaction, hereby accepting on behalf of the City, a portion of real property necessary for the extension of Adams Lane northerly from Grant Street to ultimately Lone Tree Way. The project is identified as APN’s 018-120-002, 003, 006, 008, 018-130-004, 005, 006, and 009, generally located between Lone Tree Way and Grant Street, east of O’Hara Avenue.

PREVIOUS ACTION
On August 16, 2005, by Planning Commission Resolution No. 05-53, Planning Commission approved the Prewett Ranch Project, Tentative Subdivision Map (TSM) No. 8954, which included Condition of Approval Item No. 34, requiring the extension of Adams Lane from the southerly project boundary to Grant Street. This approval also included the adoption of a mitigated negative declaration.

BACKGROUND
The Prewett Ranch Development (TSM No. 8954), located between Lone Tree Way and Grant Street, east of O’Hara Avenue, is required by the Condition of Approval to construct the extension of Adams Lane from Grant Street to Lone Tree Way. This EBMUD easement is one of the few right-of-way acquisitions necessary to complete this roadway extension.

The acceptance of the Grant of Easement from EBMUD for the extension of Adams Lane is critical to complete the missing link from Grant Street to Lone Tree Way. When this project is complete it will improve north to south traffic flow and safety, and also provide another access to Grant Street School.

The Grant of Easement will allow the Developer to construct roadway and utility improvements over the EBMUD Aqueduct for the extension of Adams Lane to Lone Tree Way and the City will maintain and repair the improvements upon acceptance.

The project will consist of constructing approximately 2,700 linear feet of a two lane collector street. The utility lines; 16” waterline and a 12” non-potable waterline will be installed as a part of Subdivision No. 8954, and will be completed with this phase. This project will also include the construction of a concrete slab over the EBMUD right-of-way.

FISCAL IMPACT
The project will be constructed by Suncrest Homes as a Condition of Approval. However, being off-site, a portion of it will be paid for by Roadway Facility Fees, as shown in the Developer Improvement Section of the CIP Budget for Adams Lane Extension, through a reimbursement agreement with Suncrest Homes for Prewett Ranch Development (TSM No. 8954).

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING AND AUTHORIZING THE CITY MANAGER OR DESIGNEE TO EXECUTE A GRANT OF EASEMENT WITH EAST BAY MUNICIPAL UTILITY DISTRICT (EBMUD), AND SUCH OTHER DOCUMENTS AS MAY BE NEEDED TO COMPLETE THE TRANSACTION, HEREBY ACCEPTING ON BEHALF OF THE CITY, A PORTION OF REAL PROPERTY NECESSARY FOR THE ADAMS LANE EXTENSION PROJECT IDENTIFIED AS APN’S 018-120-002, 003, 006, 008, 018-130-004, 005, 006, AND 009, GENERALLY LOCATED BETWEEN LONE TREE WAY AND GRANT STREET, JUST EAST OF O’HARA AVENUE.


WHEREAS, On August 16, 2005, by Planning Commission Resolution No. 05-53, Planning Commission approved the Prewett Ranch, Tentative Subdivision Map No. 8954, which included Condition of Approval Item No. 34, requiring the extension of Adams Lane from the southerly project boundary to Grant Street; and

WHEREAS, an easement over a portion of real property, generally located south of Lone Tree Way, north of Grant Street, east of the UPRR and west of Brentwood Blvd. is required to complete the missing link to extend Adams Lane from Grant Street to the southerly property boundary; and

WHEREAS, the Grant of Easement between the City of Brentwood and the vested property owner, EBMUD, has been developed and is necessary to transfer property.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby approve and authorize the City Manager or designee to execute a Grant of Easement with East Bay Municipal Utility District (EBMUD), and such other documents as may be needed to complete the transaction, hereby accepting on behalf of the City, a portion of real property necessary for the Adams Lane Improvements, identified as APN’s 018-120-002, 003, 006, 008, 018-130-004, 005, 006, and 009, generally located between Lone Tree Way and Grant Street, east of O’Hara Avenue.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting held on the 23rd day of January 2007 by the following vote:
