Subject/Title: Adopt a Resolution approving and authorizing the City Manager or designee to execute a Deferred Improvement Agreement between Robert and Claire Keith and the City of Brentwood for MS No. 356-05, located at the northwest corner of Windy Springs Lane and Amber Lane.

RECOMMENDATION
Adopt a Resolution approving and authorizing the City Manager or designee to execute a Deferred Improvement Agreement between Robert and Claire Keith and the City of Brentwood for MS No. 356-05, located at the northwest corner of Windy Springs Lane and Amber Lane, identified as APN 019-050-019, and directing the City Clerk to file the agreement with the Recorder of Contra Costa County.

PREVIOUS ACTION
On July 19, 2005, by Planning Commission Resolution No. 05-52, Planning Commission approved Tentative Parcel Map MS No. 356-05 to subdivide a 2.68 acre parcel into 4 parcels and one remainder located at the northwest corner of Windy Springs Lane and Amber Lane, with conditions.

BACKGROUND
The project known as MS No. 356-05 is located at the northwest corner of Windy Springs Lane and Amber Lane, identified as APN 019-050-019. The property consists of 2.68 acres and is being subdivided into 4 parcels and 1 remainder. The Developer has submitted plans for the frontage improvements to Windy Springs Lane and Amber Lane. The improvements include sidewalk, curb and gutter, landscape and irrigation, utilities, pavement, and signing and striping. The Developer has posted a bond in the amount of $125,119.61, to secure the work. The Developer for this project is required to enter into a Deferred Improvement Agreement with the City for the design and construction of the internal road and utilities, as and when required by the Conditions of Approval.

FISCAL IMPACT
There is no fiscal impact to the City. Per the Deferred Improvement Agreement, the cost of the improvements being deferred will be the Developer’s responsibility.

RESOLUTION NO.


A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING AND AUTHORIZING THE CITY MANAGER OR DESIGNEE TO EXECUTE A DEFERRED IMPROVEMENT AGREEMENT BETWEEN ROBERT AND CLAIRE KEITH AND THE CITY OF BRENTWOOD FOR MS NO. 356-05, LOCATED AT THE NORTHWEST CORNER OF WINDY SPRINGS LANE AND AMBER LANE, IDENTIFIED AS APN 019-050-019, AND DIRECTING THE CITY CLERK TO FILE THE AGREEMENT WITH THE RECORDER OF CONTRA COSTA COUNTY.

WHEREAS, on July 19, 2005, by Planning Commission Resolution No. 05-52, the Planning Commission approved Tentative Parcel Map MS No. 356-05 with conditions; and

WHEREAS, as a Condition of Approval of the Tentative Parcel Map, the Developer must enter into a Deferred Improvement Agreement with the City for the design and construction of the private roadway and utilities.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby approve and authorize the City Manager or designee to execute a Deferred Improvement Agreement between Robert and Claire Keith and the City of Brentwood for MS No. 356-05, located at the northwest corner of Windy Springs Lane and Amber Lane, identified as APN 019-050-019, and directs the City Clerk to file the agreement with the Recorder of Contra Costa County.
