Subject/Title: Adopt a Resolution accepting the work performed by Grade Tech, Inc. for the American Avenue Extension (Widening Phase), CIP Project No. 336-31560.

RECOMMENDATION
Adopt a Resolution accepting the work performed by Grade Tech, Inc. for the American Avenue Extension (Widening Phase), CIP Project No. 336-31560, and directing the City Clerk to file the Notice of Completion with the County Recorder.

PREVIOUS ACTION
On September 27, 2005, by Resolution No. 2005-229, City Council approved a Reimbursement Agreement with the Liberty Union High School District in the amount of $108,300, for the American Avenue/Balfour Road Intersection Modifications and authorized the City Manager to execute the said agreement and amended the American Avenue Extension, CIP Project No. 336-3156 Budget Sheet.

On May 23, 2006, by Resolution No. 2006-115, City Council adopted the City’s 2006/07 – 2010/11 Capital Improvement Program (CIP), which included the American Avenue Extension, CIP Project No. 336-3156.

On July 25, 2006, by Resolution No. 2006-175, City Council approved and authorized the City Manager to execute a construction contract and necessary documents for the American Avenue Extension (Widening Phase), CIP Project No. 336-3156 to Grade Tech, Inc. in the amount of $283,830.55, plus a 10% contingency, for a total amount of $312,213.61.

BACKGROUND
City staff has been working toward modifying the existing improvements at the intersection of Balfour Road and American Avenue to improve traffic circulation due to the opening of the Adams Middle School. The first phase, Balfour Road dual left turn lanes onto American Avenue has been completed. The second phase, which staff is requesting project acceptance tonight, created dual right turn lanes on American Avenue approaching Balfour Road. Both phases of this work have improved traffic circulation at the intersection and also to and from the High School and Middle School.

This project consisted of approximately 325 feet of roadway widening for an additional right turn lane, signal modifications, curb and gutter, storm drain modifications, widening sidewalk and bicycle path on Balfour Road from American Avenue to Mountain View Drive, slurry seal, and signing and striping. These new facilities have been inspected for conformance with the approved improvement plans. Grade Tech, Inc. has fulfilled their contractual obligation, so it is the appropriate time to accept these improvements.

FISCAL IMPACT
The total cost for American Avenue Extension (Widening Phase), CIP Project No. 336-31560 was $285,963.45, which was within the City Council approved amount of $312,213.61 and budgeted for in the 2006/07 – 2010/2011 Capital Improvement Program.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE WORK PERFORMED BY GRADE TECH, INC. FOR THE AMERICAN AVENUE EXTENSION (WIDENING PHASE), CIP PROJECT NO. 336-31560, AND DIRECTING THE CITY CLERK TO FILE THE NOTICE OF COMPLETION WITH THE COUNTY RECORDER.


WHEREAS, on September 27, 2005, by Resolution No. 2005-229, City Council approved a Reimbursement Agreement with the Liberty Union High School District in the amount of $108,300, for the American Avenue/Balfour Road Intersection Modifications and authorized the City Manager to execute the said agreement and amended the American Avenue Extension, CIP Project No. 336-3156 Budget Sheet; and

WHEREAS, on May 23, 2006, by Resolution No. 2006-115, City Council adopted the City’s 2006/07 – 2010/11 Capital Improvement Program (CIP), which included the American Avenue Extension, CIP Project No. 336-3156; and

WHEREAS, on July 25, 2006, by Resolution No. 2006-175, City Council approved and authorized the City Manager to execute a construction contract and necessary documents for the American Avenue Extension (Widening Phase), CIP Project No. 336-3156 to Grade Tech, Inc. in the amount of $283,830.55, plus a 10% contingency, for a total amount of $312,213.61; and

WHEREAS, this project has helped to increase the traffic circulation to and from the Heritage High School and Adams Middle School by the additional right turn lane on American Avenue; and

WHEREAS, Grade Tech, Inc. has completed the work to the satisfaction of the City, and in conformance to the approved plans and specifications.

NOW THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby accept the work performed by Grade Tech, Inc. for the American Avenue Extension (Widening Phase), CIP Project No. 336-31560, and direct the City Clerk to file the Notice of Completion with the County Recorder.

NOTICE OF COMPLETION


NOTICE IS HEREBY GIVEN THAT:

THE CITY OF BRENTWOOD, a general law city, in the County of Contra Costa, State of California, did enter into an agreement on July 25, 2006 with Grade Tech, Inc. for work performed on American Avenue in Brentwood for CIP Project No. 336-31560.

The work described in the contract documents was to furnish all material, labor, and equipment necessary to complete said work.

On the 23rd day of January 2007, said contract, as a whole was completed and the work was accepted by the City Council of the City of Brentwood.

I hereby certify under penalty of perjury that the facts set forth in the foregoing Notice of Completion are true and correct.
