Subject/Title: Adopt a Resolution approving and authorizing the City Manager to execute a Professional Services Agreement with Loving & Campos Architects, Inc. for the final design of Fire Station No. 53, CIP Project No. 337-37030, in the amount of $255,500, plus a 10% contingency of $25,550, for a total amount of $281,050.

RECOMMENDATION
Adopt a Resolution approving and authorizing the City Manager to execute a Professional Services Agreement with Loving & Campos Architects, Inc. for the final design of Fire Station No. 53, CIP Project No. 337-37030, in the amount of $255,500, plus a 10% contingency of $25,550, for a total amount of $281,050.

PREVIOUS ACTIONS
On February 24, 2004, by Resolution No. 2004-35, City Council approved a Professional Services Agreement with Loving & Campos Architects, Inc. for the preliminary and final design of Fire Station No. 56 (changed to No. 53) in the amount of $186,780.

On October 25, 2005, by Ordinance No. 815, City Council approved the rezone and development standards for Fire Station No. 53.

On May 23, 2006, by Resolution No. 2006-126, City Council adopted the City’s 2006/07 – 2010/11 Capital Improvement Program (CIP), which included Fire Station No. 53, CIP Project No. 337-37030.

BACKGROUND
City staff has been working with East Contra Costa Fire Protection District (Fire District) for the location of fire station sites to serve the build-out of the City. In addition to the two existing fire stations, it has been determined that another fire station is necessary. After discussions with the Fire District, a site was acquired for this third station at the northwest corner of Shady Willow Lane and Grant Street.

Due to the ongoing commercial and residential developments in the northwest quadrant of Brentwood, this new fire station is proposed to provide adequate fire protection facilities. Preliminary conceptual plans and designs for the fire station began in 2004 after City Council approved the initial contract with Loving & Campos Architects, Inc. Planning Commission reviewed the preliminary conceptual plans and designs and staff is now ready to commence with the final design and construction documents. Due to the expiration of the previous Professional Services Agreement on December 31, 2005, expertise in the design of fire stations, prior work on this project and for continuity purposes, staff recommends that Loving & Campos Architects, Inc., are best prepared and knowledgeable to begin the next phase of the work. Loving & Campos Architects, Inc. estimates the design phase of the project to be complete by July 2007, with construction anticipated in the fall of 2007.

FISCAL IMPACT
The funds associated for this contract will be paid through Fire Facility Fees under Fire Station No. 53, CIP Project No. 337-37030, which are included in the City’s adopted 2006/07 – 2010/11 Capital Improvement Program. Future developments throughout the City will pay their fair share for the station as well, through the revised fire mitigation fee that was adopted by the City Council on February 10, 2004, as part of the City’s Development Fee Program.

RESOLUTION NO.


A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING AND AUTHORIZING THE CITY MANAGER TO EXECUTE A PROFESSIONAL SERVICES AGREEMENT WITH LOVING & CAMPOS ARCHITECTS, INC., FOR THE FINAL DESIGN OF FIRE STATION NO. 53, CIP PROJECT NO. 337-37030, IN THE AMOUNT OF $255,500, PLUS A 10% CONTINGENCY OF $25,550, FOR A TOTAL AMOUNT OF $281,050.

WHEREAS, a new fire station was proposed to provide adequate fire protection facilities in the northwest quadrant of the City of Brentwood; and

WHEREAS, on February 24, 2004, by Resolution No. 2004-35, City Council approved a Professional Services Agreement with Loving & Campos Architects, Inc. for the preliminary and final design of Fire Station No. 56 (changed to No. 53) in the amount of $186,780; and

WHEREAS, on September 20, 2005, Planning Commission reviewed and approved the rezone and development standards for Fire Station No. 53, including the preliminary conceptual plans and designs;

WHEREAS, on October 25, 2005, by Ordinance No. 815, City Council approved the rezone and development standards for Fire Station No. 53 and staff is now ready to commence with the final design and construction documents;

WHEREAS, on May 23, 2006, by Resolution No. 2006-126, City Council adopted the City’s 2006/07 – 2010/11 Capital Improvement Program (CIP), which included Fire Station No. 53, CIP Project No. 337-37030; and

WHEREAS, the Professional Services Agreement with Loving and Campos Architects expired on December 31, 2005 and a new agreement is required.

NOW THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby approve and authorize the City Manager to execute a Professional Services Agreement with Loving & Campos Architects, Inc. for the final design of Fire Station No. 53, CIP Project No. 337-37030, in the amount of $255,500, plus a 10% contingency of $25,550, for a total amount of $281,050.
