Subject/Title: Adopt a Resolution authorizing the City Manager to notify East Contra Costa Fire Protection District of the City’s intent to give thirty (30) day notice of cancellation of the agreement for the Third Firefighter

RECOMMENDATION
Adopt a Resolution authorizing the City Manager to notify East Contra Costa Fire Protection District of the City’s intent to give thirty (30) day notice of cancellation of the agreement for the Third Firefighter.

PREVIOUS ACTION
On February 12, 2002, the City Council adopted Resolution No. 2469, which authorized the City Manager to approve a contract with the Fire District to increase 24-hour firefighter crews in Brentwood Fire Station Nos. 52 and 54 from two firefighters to three firefighters.

On April 25, 2006, the City Council adopted Resolution No. 2006-85 approving and authorizing the City Manager to execute an Interim Fire Protection Services Agreement with East Contra Costa Fire Protection District in the amount of $142,327.50.

On October 10, 2006, the City Council adopted Resolution No. 2006-251 approving and authorizing the City Manager to execute an Agreement for fire protection services with East Contra Costa Fire Protection District and authorizing payment in accordance with the contract for the period of January 1 through December 31, 2006.

BACKGROUND
In 2002, the County Board of Supervisors consolidated the three fire districts of East Diablo, Bethel Island and Oakley. The goal was to improve regional fire protection by converting the Paid on Call firefighters to full time, professional fire fighters which took place upon consolidation. The increased staff positions were funded by the property taxes paid to the newly consolidated District by the urban areas, in particular City of Brentwood residents and businesses.

At the same time, the City of Brentwood desired to increase the level of staff to 3 firefighters per shift. The only option provided at that time by the County was for the City to pay for the 3rd firefighter at the two fire stations in Brentwood.

Additionally, the County wanted the City to pay the full cost of operating the 3rd station which will be constructed in the next year at Shady Willow and Grant Streets.

The County engaged the services of Citygate Associates to prepare a master plan for the consolidated District. That effort has been only partially successful and has been greatly delayed. The study was supposed to be completed in the summer of 2005. The Master Plan document was finally completed in February 2006 but has not yet been accepted or approved by the Board of Supervisors, who is the governing board of the District.

The financial analysis undertaken as part of the Citygate study documented that the property taxes paid for fire protection within the City of Brentwood covers the cost of the 3rd firefighter position and the full operating cost of the 3rd fire station at Shady Willow and Grant Streets when it is fully operational.

The City has paid $1,821,436 from the General Fund for the additional positions since 2003. At the same time the District accrued a reserve of approximately $3.2 million about which City staff just recently became aware.

The current agreement requires the City to pay East Contra Costa Fire Protection District for the “third firefighter” on a quarter by quarter basis as services are provided through December 31, 2006. The agreement will extend on a quarter by quarter basis unless terminated by either Party upon thirty days advance written notice.

The attached resolution will give the City Manager authority to notify East Contra Costa Fire Protection District of the City’s intent to give thirty (30) day notice of cancellation of the agreement for the Third Firefighter.

RELATED ISSUES
There are numerous other issues related to the future fire service for the City of Brentwood, including but not limited to:
• Governance – what role does the City Council have in determining how District resources are allocated;
• Who should be the provider of the fire service (California Department of Forestry and Fire Protection (CDF) vs. the District);
• The level of compensation for the fire fighters;
• Who should provide the fire prevention services (i.e. plan checking) which are currently done by Consolidated Fire;
• Will the taxpayers of the City of Brentwood and the rest of the District be willing to pay higher taxes or assessments for additional staff and advanced life support; and
• Whether the City should continue as part of the District or form a City run fire department or a joint department with the City of Oakley.

These questions are not part of the recommended action to cancel the agreement. The City Manager and Councilmember Brockman have actively participated in all of the meetings and discussions about the future of fire service. We will bring additional recommendations to the Council in the future as the study process continues.

FISCAL IMPACT
The estimated amount contributed to East Contra Costa Fire Protection District from January 2003 through December 2006 for the “third firefighter” will total $1,966,926. An additional contribution estimated to be $143,908.92 will be required for the period of January through March 2007. If the Agreement is canceled further funds would not be expended and would remain in the General Fund.
