Subject/Title: Approve a Resolution authorizing submittal of a grant proposal to the Metropolitan Transportation Commission FY 2007/2008 Transportation Development Act (TDA) Article 3 Pedestrian/Bicycle Program for funding of the Trail System Signage Project, a component of the Trails Project, CIP 522-52120.

RECOMMENDATION
Approve a resolution authorizing submittal of a grant proposal in the amount of $10,950 to the Metropolitan Transportation Commission FY 2007/2008 Transportation Development Act (TDA), Article 3 Pedestrian/Bicycle Program for funding of the Trail System Signage Project, a component of the Trails Project, CIP 522-52120.

BACKGROUND
The Transportation Development Act (TDA) funds are derived from ¼ of each cent of the State sales tax returned to the county of origin and distributed to the cities and counties on a population basis. By State law, 2% of each entity’s TDA allocation is set aside for bicycle and pedestrian paths as TDA Article 3 funds.

Staff recommends an application in the amount of $10,950 for the Trail System Signage project which includes the purchase and installation of destination and distance signs directing users to public facilities and points of interest along trails within the City and the installation of street name signs at trail crossings of arterial roadways. The project will also construct an additional curb cut on westbound Balfour Road east of Marsh Creek to improve bicycle access to the Marsh Creek Trail.

The project has been proposed by City of Brentwood Bicycle Committee members as it relates to the East Contra Costa County Bicycle Plan. Trail signage is needed to make the trails easier to follow and more enjoyable to use in the process. The signs will make it possible to navigate the trails without a map and users will have a reasonable idea of where they are and be able to identify their location to others.

FISCAL IMPACT
The estimated cost for this project is $11,950. Staff recommends an application for TDA funds in the amount of $10,950. The remainder of $1,000 has been budgeted in the Trails Project, CIP 522-52120.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE SUBMITTAL OF A GRANT PROPOSAL TO THE METROPOLITAN TRANSPORTATION COMMISSION (MTC) FOR THE ALLOCATION OF FISCAL YEAR 2007/2008 TRANSPORTATION DEVELOPMENT ACT (TDA) ARTICLE 3 PEDESTRIAN/BICYCLE PROJECT FUNDING FOR THE TRAIL SYSTEM SIGNAGE PROJECT, A COMPONENT OF THE TRAILS PROJECT, CIP 522-52120.

WHEREAS, Article 3 of the Transportation Development Ace (TDA), Public Utilities Code (PUC) Section 99200 et seq., authorizes the submission of claims to a regional transportation planning agency for the funding of projects exclusively for the benefit and/or use of pedestrians and bicyclists; and

WHEREAS, the Metropolitan Transportation Commission (MTC), as the regional transportation planning agency for the San Francisco Bay region, has adopted MTC Resolution No. 875, Revised, entitled “Transportation Development Act, Article 3, Pedestrian/Bicycle Projects,” which delineates procedures and criteria for submission of requests for the allocation of “TDA Article 3” funding; and

WHEREAS, MTC Resolution No. 875, Revised requires that requests for the allocation of TDA Article 3 funding be submitted as part of a single, countywide coordinated claim from each county in the San Francisco Bay region; and

WHEREAS, the City of Brentwood desires to submit a request to MTC for the allocation of TDA Article 3 funds to support the projects described in Attachment B to this resolution, which are for the exclusive benefit and/or use of pedestrians and/or bicyclists.

NOW, THEREFORE BE IT RESOLVED:
1. That submittal of the grant proposal to the Metropolitan Transportation Commission is hereby authorized;
2. That the City of Brentwood declares it is eligible to request an allocation of TDA Article 3 funds pursuant to Section 99234 of the Public Utilities Code;
3. That there is no pending or threatened litigation that might adversely affect the project described in Attachment B to this resolution, or that might impair the ability of the City of Brentwood to carry out the project;
4. That the City of Brentwood attests to the accuracy of and approves the statements in Attachment A to this resolution; and
5. That a certified copy of this resolution and its attachments, and any accompanying supporting materials shall be forwarded to the countywide transportation planning agency of Contra Costa County for submission to MTC as part of the countywide coordinated TDA Article 3 claim.

1. That the City of Brentwood is not legally impeded from submitting a request to the Metropolitan Transportation Commission for the allocation of Transportation Development Act (TDA) Article 3 funds, nor is the City of Brentwood legally impeded from undertaking the project described in “Attachment B” of this resolution.

2. That the City of Brentwood has committed adequate staffing resources to complete the project described in Attachment B.

3. A review of the project described in Attachment B has resulted in the consideration of all pertinent matters, including those related to environmental and right of way permits and clearances, attendant to the successful completion of the project.

4. Issues attendant to securing environmental and right of way permits and clearances for the projects described in Attachment B have been reviewed and will be concluded in a manner and on a schedule that will not jeopardize the deadline for the use of the TDA funds being requested.

5. That the project described in Attachment B complies with the requirements of the California Environmental Quality Act (CEQA, Public Resources Code Sections 21000 et seq.) as follows:

 The proposed project will install signage along existing trails and therefore meets the requirements for a Class 1 Categorical Exemption under CEQA Article 19, Section 15301(3), Existing Facilities.

6. That as portrayed in the budgetary description of the project in Attachment B, the sources of funding other than TDA are assured and adequate for completion of the project.

7. That the project described in Attachment B is for capital construction.

8. That the bicycle/pedestrian project described in Attachment B has been included in a detailed bicycle circulation element and is included in East Contra Costa County Bicycle Plan.

9. That the project described in Attachment B which is on a “Class I Bikeway,” meets the mandatory minimum safety design criteria published in Chapter 1000 of the California Highway Design Manual (refer to Section 1003.3 (3), Destination Signing).

10. That the project described in Attachment B is ready to commence implementation during the fiscal year of the requested allocation.

11. That the City of Brentwood agrees to maintain, or provide for the maintenance of, the project described in Attachment B, for the benefit of and use by the public.

The Trails Project, CIP No. 522-52120 was approved as part of the 2006/07 – 2010/11 Capital Improvement Program on May 23, 2006. Council will consider the 2007/08 TDA Article 3 application for Trail System Signage on December 12, 2006 and the certified resolution will be forwarded as soon as it is available from the City Clerk’s office. A copy of the resolution is attached to this application for reference.

B. Has the public availability of the environmental compliance documentation for the project (pursuant to CEQA) been evidenced by the dated stamping of the document by the county clerk or county recorder?

The project is a class 1 categorical exemption from CEQA per Article 19, Section 15301(C), “Existing highways and streets, sidewalks, gutters, bicycle and pedestrian trails, and similar facilities.” The Notice of Exemption will be forwarded once it has been processed by the Contra Costa County Clerk Recorder.
