Subject/Title: Adopt a Resolution approving a Contract Change Order with Marina Mechanical to provide and install 1.5 ton zone mechanical unit for rear portion of the building, CIP Project No. 337-37130, in the amount of $8,300, plus a 10% contingency and authorizing the City Manager to execute said Amendment and related change order documents.

RECOMMENDATION
Adopt a Resolution approving a Contract Change Order with Marina Mechanical to provide and install 1.5 ton zone mechanical unit for rear portion of the building at 118 Oak Street, CIP Project No. 337-37130, in the amount of $8,300, plus a 10% contingency and authorizing the City Manager to execute said Amendment and related change order documents.

PREVIOUS ACTION
On May 23, 2006, by Resolution No. 2006-126, City Council adopted the City’s 2006/07 – 2010/11 Capital Improvement Program (CIP), which included the 118 Oak Street Remodel, CIP Project No. 337-37130.

BACKGROUND
The improvements to 118 Oak Street will produce a tenant space that has few stationary walls, is extremely flexible and is able to accommodate a wide variety of future uses. Improvements include handicapped accessible restroom facilities, a conference room and access to adjoining City facilities. Completion of these improvements will provide temporary office space for Community Development Department staff. This flexible space will allow for the return of the Community Development Building Inspectors from the Tech Center, freeing rentable City space with the potential of bringing additional revenue to the City.

The 118 Oak Street Building Improvements are being constructed as a multi prime project which allows staff to better control the work and costs associated with construction. The City requested informal bids for the construction of the multi prime project on August 10, 2006. After receiving two bids for package #4-Mechanical/HVAC, staff executed a contract agreement consistent with the City’s Budget and Purchasing Policy. In our bid document a Bid Alternate #1 to provide a 1.5 ton zone at conference and large office at rear portion of building, rooms 208 and 209 was included but inadvertently left out of the executed agreement. The alternate is necessary to adequately provide equal distribution of conditioned air to all the spaces in the rear portion of the building. This change order will restore Bid Alternate #1 to the contract and will allow the construction on that improvement to proceed. This contract is being presented to Council because the total contract price including Bid Alternate # 1 - $51,110 plus a 10% contingency of $5,111, exceeds staffs ability to execute an agreement without Council’s approval.

Staff recommends approving a Contract Change Order with Marina Mechanical to provide and install 1.5 ton zone mechanical unit for rear portion of the building at 118 Oak Street, CIP Project No. 337-37130, in the amount of $8,300, plus a 10% contingency and authorizing the City Manager to execute said Amendment and related change order documents.

FISCAL IMPACT
This work has been budgeted as part of CIP Project 337-37130, which is included in the City’s adopted 2006/07 – 2010/11 Capital Improvement Program.

A RESOLUTION APPROVING A CONTRACT CHANGE ORDER WITH MARINA MECHANICAL TO PROVIDE AND INSTALL 1.5 TON ZONE MECHANICAL UNIT FOR REAR PORTION OF THE BUILDING AT 118 OAK STREET, CIP PROJECT NO. 337-37130, IN THE AMOUNT OF $8,300, PLUS A 10% CONTINGENCY OF $830 AND AUTHORIZING THE CITY MANAGER TO EXECUTE SAID AMENDMENT AND RELATED CHANGE ORDER DOCUMENTS.

WHEREAS, on May 23, 2006, by Resolution No. 2006-126, City Council adopted the City’s 2006/07 – 2010/11 Capital Improvement Program (CIP), which included the 118 Oak Street Remodel, CIP Project No. 337-37130; and

WHEREAS, the improvements to 118 Oak Street will produce a tenant space that has few stationary walls, is extremely flexible and is able to accommodate a wide variety of future uses; and

WHEREAS, the 118 Oak Street Building Improvements will be constructed as a multi prime project which allows staff to better control the work and costs associated with construction; and

WHEREAS, the City requested informal bids for Bid Package #4 – Mechanical/HVAC and two bids were received on August 30, 2006; and

WHEREAS, The lowest bid was received from Marina Mechanical, with a base bid of $42,510 and Bid Alternate #1 of $8,300.

NOW THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby approve the Contract Change Order with Marina Mechanical to provide and install 1.5 ton zone mechanical unit for rear portion of the building at 118 Oak Street, CIP Project No. 337-37130, in the amount of $8,300, plus a 10% contingency and authorizing the City Manager to execute said Amendment and related change order documents.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting held on the 12th day of December 2006 by the following vote:
