Subject/Title: Adopt a Resolution accepting off-site Shady Willow Lane public improvements (a portion of CIP Project No. 336-31430) constructed as a part of Arbor Ridge Apartments, Design Review No. 02-11, located south of Lone Tree Way and east of Shady Willow Lane.

RECOMMENDATION
Adopt a Resolution accepting off-site Shady Willow Lane public improvements (a portion of CIP Project No. 336-31430) for maintenance, accepting the Encroachment Permit Maintenance Bond and releasing the Improvement Securities for this work, constructed as a part of Arbor Ridge Apartments, Design Review No. 02-11, located south of Lone Tree Way and east of Shady Willow Lane.

PREVIOUS ACTION
On March 10, 2003, by Resolution No. 03-10, the Planning Commission approved Design Review No. 02-11, with conditions.

On August 19, 2003 and January 18, 2005, the Planning Commission amended Resolution No. 03-10, amending the Conditions of Approval for Design Review No. 02-11.

On March 23, 2004, by Resolution 2004-60, City Council approved a Reimbursement Agreement with Ashwood Construction for Shady Willow Lane (a portion of CIP Project No. 336-31340) Master Planned Facilities.

BACKGROUND
This project, located south of Lone Tree Way and east of Shady Willow Lane was approved for a 178 unit apartment complex and a community building on an approximate 14 acre parcel. Included as a part of the Conditions of Approval, the project was required to construct the full width of Shady Willow Lane from Lone Tree Way to the southerly property line of the project. Shady Willow Lane is an arterial street shown in the CIP budget that is necessary for the north/south circulation of the City. In addition to the roadway, master planned water and sewer utilities, and a traffic signal at the project’s main entrance were also constructed. All public improvements required by the Conditions of Approval for this project have been constructed and inspected for conformance with the approved improvement plans including sewer, water and storm drain lines, sidewalk, paving, streetlights and fiber optics. The Developer’s contractor, Ashwood Construction, has provided a Maintenance Bond to cover the twelve-month warranty period for the public improvements.

As required by the Conditions of Approval and shown on the improvement plans, the following improvement quantities have been installed: 1,385 LF of 8” and 10” sewer lines, 1,436 LF of 4”-16” waterlines, 534 LF of 18” and 42” storm drain lines, 2,230 LF of curb and gutter, 11,535 LF of 5’ sidewalk, 1,213 LF of pavement, 6 streetlights, 1,200 LF of joint trench including fiber optic conduit and a traffic signal.


FISCAL IMPACT
Upon acceptance of improvements the City will incur annual costs associated with necessary maintenance of streets, landscaping and utilities. Routine roadway maintenance will be funded by the General Fund and Measure “C” gas tax, with sewer and water maintenance funded through their respective enterprise funds. Landscaping and Lighting Assessment District (LLD) No. 02-3 has been formed for this subdivision and will be responsible for the street lighting and landscape maintenance.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING OFF-SITE SHADY WILLOW LANE PUBLIC IMPROVEMENTS (A PORTION OF CIP PROJECT NO. 336-31430) FOR MAINTENANCE, ACCEPTING THE ENCROACHMENT PERMIT MAINTENANCE BOND AND RELEASING THE IMPROVEMENT SECURITIES FOR THIS WORK, CONSTRUCTED AS A PART OF ARBOR RIDGE APARTMENTS, DESIGN REVIEW NO. 02-11, LOCATED SOUTH OF LONE TREE WAY AND EAST OF SHADY WILLOW LANE.

WHEREAS, On March 10, 2003, by Resolution No. 03-10, the Planning Commission approved Design Review No. 02-11 with conditions; and

WHEREAS, on August 19, 2003 and January 18, 2005, the Planning Commission amended Resolution No. 03-10, amending the Conditions of Approval for Design Review No. 02-11; and

WHEREAS On March 23, 2004, by Resolution 2004-60, City Council approved a Reimbursement Agreement with Ashwood Construction for Shady Willow Lane (a portion of CIP Project No. 336-31340) Master Planned Facilities; and

WHEREAS, the required public improvements, have been completed and constructed in substantial conformance with the approved improvement plans.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood with respect to Design Review No. 02-11, Arbor Ridge Apartments that;
1. All off-site public improvements for maintenance are hereby accepted.
2. The Maintenance Bond to guarantee against defects in material and workmanship for a period of twelve months is hereby accepted.
3. The Performance and Payment Bonds will be released within sixty (60) days of the passage of this Resolution.
4. The City Clerk is hereby directed to file this Resolution with the Recorder of Contra Costa County.
