RECOMMENDATION
Adopt a Resolution approving and authorizing the City Manager or her designee to execute a Deferred Improvement Agreement between Larry and Barbara Jackson and the City of Brentwood for DR No. 04-26, Sunset Plaza, located at 7710 Brentwood Boulevard, identified as APN 016-170-009, and directing the City Clerk to file the agreement with the Recorder of Contra Costa County.

PREVIOUS ACTION
On January 18, 2005, by Planning Commission Resolution Number 05-03, Planning Commission approved Design Review (DR) No. 04-26 for the construction of Sunset Plaza Center with conditions.

BACKGROUND
The project known as Sunset Plaza Center is located at 7710 Brentwood Boulevard, identified as APN 016-170-009. The property consists of 2.74 acres. The construction includes six (6) buildings, providing a total of 50,338 square feet of retail space. There are currently two driveways, one at Brentwood Boulevard and the other at Nancy Street. The Developer for this project is conditioned to enter into a Deferred Improvement Agreement with the City. Per the agreement, once the northerly property develops and a reciprocal access is made available, the Developer is required to close the driveway access at Brentwood Boulevard, design and construct related frontage improvements and modify the parking lot for access through the northerly property. The Developer is also required to execute a reciprocal access easement with the northerly property owner.

FISCAL IMPACT
There is no fiscal impact to the City. Per the Deferred Improvement Agreement, the cost of the improvements being deferred will be the Developer’s responsibility.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING AND AUTHORIZING THE CITY MANAGER OR HER DESIGNEE TO EXECUTE A DEFERRED IMPROVEMENT AGREEMENT BETWEEN LARRY AND BARBARA JACKSON AND THE CITY OF BRENTWOOD FOR DR NO. 04-26, SUNSET PLAZA, LOCATED AT 7710 BRENTWOOD BOULEVARD, IDENTIFIED AS APN 016-170-009 AND DIRECTING THE CITY CLERK TO FILE THE AGREEMENT WITH THE RECORDER OF CONTRA COSTA COUNTY.

WHEREAS, on January 18, 2005, by Planning Commission Resolution No. 05-03, the Planning Commission approved DR 04-26 with conditions; and

WHEREAS, as a Condition of Approval of the Design Review, the developer must enter into a Deferred Improvement Agreement with the City for the closure of the driveway access to Brentwood Boulevard; and

WHEREAS, the Deferred Improvement Agreement shall include the design and construction of related frontage improvements to modify the parking lot for access through the northerly property; and

WHEREAS, the Deferred Improvement Agreement also requires that the Developer provide a reciprocal access easement to the northerly property.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby approve and authorize the City Manager or her designee to execute a Deferred Improvement Agreement between Larry and Barbara Jackson and the City of Brentwood for DR No. 04-26, Sunset Plaza, located at 7710 Brentwood Boulevard, identified as APN 016-170-009, and directing the City Clerk to file the agreement with the Recorder of Contra Costa County.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting held on the 14th day of November 2006 by the following vote:
