RECOMMENDATION
Adopt a Resolution to reject the bids received for the Second Street / Pine Street Traffic Signal, CIP Project No. 336-31580 and direct staff to review design alternatives prior to readvertising and rebidding the project.

PREVIOUS ACTION
On May 23, 2006, by Resolution No. 2006-115, City Council adopted the City’s 2006/07 – 2010/11 Capital Improvement Program (CIP), which included the Second Street / Pine Street Traffic Signal, CIP Project No. 336-31580.

On August 22, 2006, by Resolution No. 2006-192, City Council rejected the bid for the Second Street / Pine Street Traffic Signal, CIP Project No. 336-31580 and directed staff to readvertise, rebid the project and return to City Council for award of the contract.

BACKGROUND
In an effort to improve pedestrian flow and safety for students crossing Second Street, as well as parents picking up and dropping off their students, it has become necessary to add a traffic signal and make improvements to the intersection and high school pick up / drop off areas. These improvements will increase the efficiency of the pick up / drop off areas and provide congestion relief to motorists and bicyclists traveling through this intersection. City staff worked closely with the Liberty Union High School District on the design of these improvements and has received approval from the Department of the State Architect.

This project was advertised beginning July 21, 2006 and the bids were opened on Thursday, August 10, 2006. One bid was received from Steiny and Company in the amount of $964,880; which was twice the amount of the engineer’s estimate potentially putting the project $500,000 over budget if the bid was accepted. After City Council rejected the bid, staff reviewed the plans and specifications in an attempt to reduce the scope and garner more interest in this project.

The project was advertised for the second time beginning August 25, 2006 and bids were opened on Thursday, September 21, 2006. Two bids were received; Prism Engineering, Inc. in the amount of $779,640 and W.L. Bradley Electric in the amount of $948,000.75, both well over the engineer’s estimate of $422,000. City staff met with Liberty Union High School District staff and the City has been advised that the School District’s budget will not allow additional prorated funding for this project. City staff respectfully requests that these bids be rejected and that staff be directed to review design alternatives in order to lower the cost of construction.
FISCAL IMPACT
There are funds available in the project budget to cover redesign costs, as well as costs for readvertising and reproducing additional contract documents and plan sets for sale.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD TO REJECT THE BIDS RECEIVED FOR THE SECOND STREET / PINE STREET TRAFFIC SIGNAL, CIP PROJECT NO. 336-31580 AND DIRECT STAFF TO REVIEW DESIGN ALTERNATIVES PRIOR TO READVERTISING AND REBIDDING THE PROJECT.
